Dear Sir,
We are thankful for your letter dated 29.06.2020 asking for our
suggestions as to the mode of functioning in the Principal Bench and
Madurai Bench of our High Court with regard to hearing of cases.
Pursuant to the said letter we have sought for the views of the
members of our Association.
We have received an equally mixed response from the members of the
Bar. On the basis of the views expressed by our Members we are
submitting the suggestions as under :
The majority of members of the Bar, both at the High Court level and
in the Subordinate Courts are now feeling the pinch financially due to the
stoppage of open Court hearings and physical filing procedure. Many are
not comfortable with email filing and video conference hearings, and also
that cases are not numbered and posted for hearing soon and to follow it
up is difficult, is the complaint.
A section of the Bar still feels it is not safe to open Courts at this
stage and the present system of Video Conferencing may continue.
To balance the interest of all the stake holders and all participants in
the institution we appeal to the Hon’ble Chief Justice and the Hon’ble
Companion Judges to kindly consider:
(i) Opening of the Courts for physical filing of cases and hearing in
the High Court initially for all motion cases such as fresh
admissions on all sides, bail, anticipatory bail, etc.,
