1996 ஆம் ஆண்டு “இனிய உதயம்” தமிழ் பத்திரிகையில் ஆரூர் தமிழ்நாடன் என்ற எழுத்தாளர் எழுதிய “ஜுகிபா” கதை வெளியானது. அதே கதை மீண்டும்” தித்திக் தீபிகா “என்ற நாவலிலும் 2007 ஆம் ஆண்டு வெளியானது. இந்நிலையில் 2010 ஆம் ஆண்டு இயக்குனர் ஷங்கர் இயக்கத்தில் “எந்திரன்” திரைப்படம் வெளியான பின்பு தான் ஜுகிபா கதை திருடப்பட்டு எந்திரன் திரைப்படத்தின் கதை அமைக்கப்பட்டிருந்தது தெரியவந்தது. அதைத்தொடர்ந்து எழுத்தளார் ஆரூர் தமிழ்நாடன் எந்திரன் திரைப்படத்தின் தயாரிப்பாளர் சன் பிக்சர்ஸ் கலாநிதி மாறன் மற்றும் டைரக்டர் சங்கர் இருவருக்கும் வழக்கறிஞர் நோட்டீஸ் அனுப்பினார். அவர்களிடமிருந்து எந்த பதிலும் வராத நிலையில் எழுத்தாளர் ஆரூர் தமிழ்நாடன் சென்னை போலீஸ்கமிஷனர் அலுவலகத்தில் எந்திரன் திரைப்படத்தின் இயக்குனர் ஷங்கர் மீதும், படத்தின் தயாரிப்பாளரான கலாநிதிமாறன் மீது காப்புரிமை சட்டப்படி புகார் அளித்திருந்தார்.

1996 இல் தான் எழுதிய கதையை திருடி எந்திரன் எனும் திரைபடத்தை எடுத்துவிட்டு கோடிக்கணக்கில் சம்பாதிப்பதாகவும், இது காப்புரிமை சட்டத்தின்படி கிரிமினல் குற்றம் எனவே இந்த வழக்கில் அவர்கள் தண்டிக்கப்பட வேண்டும் என புகார் கொடுத்திருந்தார். இந்த புகாரை நீண்ட விசாரணைக்கு எடுத்துக் கொண்ட போலீசார் இறுதியில் எந்த வழக்கும் பதிவு செய்யவில்லை. இதனால் இந்த வழக்கை எழும்பூர் 13 வது நீதிமன்றத்தில் எழுத்தாளர் ஆரூர் தமிழ்நாடன் தனிப்பட்ட முறையில் கிரிமினல் வழக்காக இயக்குனர் ஷங்கர் மீதும், தயாரிப்பாளரான கலாநிதி மாறன் மீதும் தொடுத்திருந்தார் .

அந்த வழக்கு நீதிமன்றத்தில் பதிவு செய்யப்பட்டு சம்பந்தப்பட்ட இருவரும் எழும்பூர் 13ஆவது நீதிமன்றத்தில் ஆஜராகும்படி 2011ல் சம்மன் அனுப்பப்பட்டது. அந்த சம்மனை அடுத்து இயக்குனர் ஷங்கரும் கலாநிதிமாறனும் எழுத்தாளர் ஆரூர் தமிழ்நாடன் எழும்பூர் நீதிமன்றத்தில் தொடுத்திருக்கும் வழக்கு சட்டப்படி செல்லாது நாங்கள் கதையை திருடவில்லை எனவே அந்த வழக்கு செல்லாது என உத்தரவிட வேண்டி சென்னை உயர்நீதிமன்றத்தில் மனு தாக்கல் செய்து முறையிட்டனர்.

எழும்பூர் நீதிமன்ற வழக்கிற்கு உயர் நீதிமன்றம் தடை விதித்து இருந்தது.
இந்த வழக்கு கடந்த 10 வருடங்களாக சென்னை உயர் நீதிமன்றத்தில் நடந்து வந்தது. அந்த வழக்கில் 6 .6.2019 அன்று நீதிபதி திரு. புகழேந்தி அவர்களால் தீர்ப்பு வழங்கப்பட்டது. அந்த தீர்ப்பில்,

கலாநிதிமாறன் மீது எழுத்தாளர் ஆரூர் தமிழ்நாடன் தொடுத்த வழக்கு செல்லாது எனவும், இயக்குனர் ஷங்கர் மீது காப்புரிமைச் சட்டத்தின் கீழ் இந்த வழக்கை நடத்த முகாந்திரம் உள்ளது எனக்கூறிய நீதிமன்றம் கதை ஒரே மாதிரி இருப்பதாக கூறி கதைக்கும் சினிமாவுக்கும் உள்ள 16 ஒற்றுமைகளை பட்டியலிட்டு காட்டி அதன்மூலம் காப்புரிமை மீறல் அப்பட்டமாக தெரிகிறது அதனால் எழும்பூர் நீதிமன்றத்தில் தொடுக்கப்பட்ட சங்கருக்கு எதிரான வழக்கை காப்புரிமை சட்டப்படி தொடர்ந்து நடத்த உத்தரவிட்டுள்ளது.

கூடுதல் அம்சமாக இயக்குனர் சங்கர் பிரபலமானவர் என்பதால் நீதிமன்றத்தில் ஆஜராகும் போது அங்கு கூட்டம் கூடுவது மற்றும் அலுவலக இடையூறுகள் ஏற்படும் என்பதால் நீதிமன்றத்திற்கு தேவைப்படும்போது மட்டும் அவர் ஆஜரானால் போதும் எல்லா வாய்தாவிற்கும் அவர் ஆஜராக தேவையில்லை என உத்தரவு பிறப்பித்துள்ளது. இதையடுத்து எழும்பூர் நீதிமன்றத்தில் வழக்கு விசாரணை தொடங்க இருந்த நிலையில் கொரோனா பேரிடர் காரணமாக நீதிமன்ற பணிகள் பாதிக்கப்பட்டிருந்த நிலையில் இயக்குனர் சங்கர் சென்னை உயர்நீதிமன்ற தீர்ப்பு எதிர்த்து உச்சநீதிமன்றத்தில் மேல்முறையீடு செய்துள்ளார். இந்த மனு உச்ச நீதிமன்றத்தில் இன்று விசாரணைக்கு வந்தது. . இயக்குனர் சங்கர் எழும்பூர் நீதிமன்றத்தில் இந்த வழக்கில் ஒரு முறை கூட ஆஜராகவில்லை, இதே எழுத்தாளர் சென்னை உயர்நீதிமன்றத்தில் ஒரு கோடி நஷ்ட ஈடு கேட்டு தாக்கல் செய்துள்ள சிவில் வழக்கில் உயர்நீதிமன்றம் சாட்சியம் அளிக்குமாறு உத்தரவிட்ட பிறகும் சங்கர் ஆஜராகவில்லை என்பது குறிப்பிடத்தக்கது.
[10/12, 12:03] Ram Sankar Bci Advt: Director Shankar has approached the Supreme Court challenging the Final order of the Madras High Court that the Copyright violation case against him for the Tamil Movie ‘Endhiran’ cannot be dismissed.

Mr.Aarur Tamilnadan, a writer from Tamilnadu had written a story titled ‘Jiguba’ which was published in the Tamil Magazine ‘Iniya Udhayam’ during the year 1996. The same story was re-published in 2007 in another Novel titled ‘Dhik Dhik Dheepika’. At this juncture, in 2010 after the release of the Tamil movie ‘Endhiran’ under the direction Mr.Shankar, it was found that the story of ‘Endhiran’ was copied from the story of ‘Jiguba’. Mr.Aarur Tamilnadan, the author of ‘Jiguba’ immediately sent a legal notice to Mr.Kalanidhi Maran, the Producer and Mr.Shankar, the Director of the film ‘Endhiran’. Since there was no reply from either of them, Mr.Aarur Tamilnadan filed a complaint of Copyright Violation to the Commissioner of Police, Chennai against both of them.

The compliant stated that the director and producer had copied his story to create the film ‘Endhiran’ which was a mere violation of the Copyright Act,1957. Further, they had earned a huge monetary benefit (in crores) from the film which was originally the idea and creation of the complainant and therefore a punishable offence under the Copyright Act, 1957. Mr.Aarur Tamilnadan filed this complaint seeking for legal action against the producer and the director, but the Police authorities did not file any complaint even after investigating for a long period of time. Therefore, the complainant filed a Criminal case through private complaint against Mr.Kalanithi Maran and Mr.Shankar before the 13th Metropolitan Magistrate Court, Egmore, Chennai.

The Criminal case was filed and the 13th Metropolitan Magistrate Court summoned both the accused person to appear before the court in 2011. Following this, Mr.Kalanithi Maran and Mr.Shankar filed a Quash petition before the Hon’ble High Court of Madras seeking an order to quash the proceedings before the Egmore Magistrate stating that the story was not copied from Mr.Aarur Tamilnadan and therefor his complaint was invalid.

The Hon’ble High Court of Madras granted a stay order for the case before the Egmore Magistrate. This case has been proceeding in the Madras High Court over the past 10 years. On 06.06.2019, Hon’ble Justice. Pugazhendhi delivered his judgement in this case. As per the verdict, it was held that the complaint of Mr.Aarur Tamilnadan against Mr.Kalanithi Maran was invalid. However, the court admitted the case against the director Mr.Shankar and stated that there were 16 similarities between the story and the film. The verdict contained a table enlisting the similarities between the story and the film. The court held that the alleged Copyright violation was proved and therefore directed the Egmore Magistrate Court to resume the proceedings under Copyright Act against Director.Shankar.

Moreover, an order was passed stating that Mr.Shankar shall not be required to appear before the court in all hearings because he was a famous personality and that his appearance before the court would lead to public crowd and administrative complications. Therefore, he shall be required to appear in hearings only when required specifically by the court. At this juncture where the Egmore Magistrate Court was about to initiate the proceedings and resume investigation, the regular activities of the court were restricted by the COVID-19 pandemic. Now after one year Mr.Shankar has approached the Supreme Court by way of an appeal against the judgement passed by the Madras High Court. The appeal is expected to be heard by the Supreme Court very soon.

Director Shankar has not appeared before the Egmore Magistrate Court even once. It is pertinent to note that the civil case filed by the same writer before the Hon’ble High Court of Madras against Director Shankar is pending and he has failed to appear before the court even after the Hon’ble High Court passing a specific order directing him to appear and adduce evidence.
