” We are informed by the Secretary of the Supreme Court Bar Association (SCBA) that 77 advocates who were members of SCBA have lost their lives to COVID-19. We pay our deepest condolences. We will observe two-minute silence for the departed souls,”
Now this is as regards the statistics as on 28th June 2021 and only wrt the SCBA.
Infact even the Madurai Bar Assn. repd that the members lawyers practicing in rural areas suffer and Madurai Bar Association wrote to TN CM, for compensation for families of advocates who died of COVID-19.
. . If i recollect the president and secretary of the Madurai association had called upon the government to pay compensation of ₹25 lakh to the family of a Chief Judicial Magistrate who died due to COVID-19. Also let’s take the health of our Judges themselves , most of them are above 50. The stress could have affected their health, diabetes and hypertension. These are comorbidities for COVID and omicron Possibly a consensus could be arrived at with the Bar and the Health department of the State Government.
The news from Karnataka is also worrisome it is reported that 16 judicial staff, 190 lawyers died due to Covid in 48 days’: Karnataka High Court

2768 judicial officers and 106 Judges of the High Court have tested positive. Now this was expressed by our CJI in May

[12/30, 08:54] Srimathi Advt Mhc: The Bar should impress on the proposal of the Chief Justice of India for setting up a National Judicial Infrastructure.

As anyone of us can see there are three issues that are problematic
1. Lack of basic infrastructure, to increase the number of judges and financial help to deserving lawyers.
Now if and of course when we overcome these problems can there be real access to justice.
2. As regards pending cases, the shortage of judges maybe a reason, but also a lack of necessary infrastructure. Our Bar and Advocates should impress on those in authority for providing necessary infrastructure.

3. In many rural and mofussil areas the plight of the judges and lawyers is heart rending. They are conducting proceedings in dilapidated court buildings.
4. A counsel from Trichy Bar was saying that the 4 massive court halls With high ceilings have been kept closed. If only repairs could be carried out and the buildings used not only will we have Heritage buildings restored we can as lawyers prevent them from crumbling and falling apart.
5. Now many lawyers in the cities have access to network while our brothers and sisters in the Rural and District courts – Mofussil have problems, maybe we should explore setting up a mobile network on vans to facilitate lawyers in rural areas to attend court duties virtually. 6. Lawyers who can afford it and are in cities and towns will be able to attend court through video conferencing, advocates in rural areas and who cannot afford the network and it is worrisome as our profession requires the presence.

As anyone of us can see there are three issues that are problematic

3. In many rural and mofussil areas the plight of the judges and lawyers is heart rending. They are conducting proceedings in dilapidated court buildings.
4. A counsel from Trichy Bar was saying that the 4 massive court halls With high ceilings have been kept closed. If only repairs could be carried out and the buildings used not only will we have Heritage buildings restored we can as lawyers prevent them from crumbling and falling apart.
5. Now many lawyers in the cities have access to network while our brothers and sisters in the Rural and District courts – Mofussil have problems, maybe we should explore setting up a mobile network on vans to facilitate lawyers in rural areas to attend court duties virtually. 6. Lawyers who can afford it and are in cities and towns will be able to attend court through video conferencing, advocates in rural areas and who cannot afford the network and it is worrisome as our profession requires the presence.

Covid has clearly created a divide among every class. Those who doesnot have access to technology/familiar with technology will definitely suffer. So for them physical hearing will solve the issue.

But those with comorbidities, age related factors should be given an option to stay at home and argue. That is their fundamental right to choose the mode. Forcing anyone to attend a physical hearing against their fear and wish is not just.

Hybrid model satisfy both the sides. My humble opinion is High Court should resume VC along with Physical particularly in view of heightened omicron threat. Thanks🙏
