O.A.No.61 of 2023 in the instant suit. It is further brought to the notice of this Court that the film had been released as early as in the year 2024 and in that regard, the prayer sought for by the plaintiff had become infructuous. The plaintiff had not taken any steps in the manner known to law for the amendment of the reliefs. 3. Rule 1 of of Original Side Rules r/w.Sections 27, 134 & 135 of the Trademarks

a) Granting an order of Permanent Injunction, restraining all the Defendants herein from showing the teaser clips and stop promotion of the movie in the title of SAAMANIYAN in various medias like Posters, Print Media, TV and Internet and releasing the same in Cinema Theatres in all Languages, exhibiting or exploiting of the Suit Schedule Film SAAMANIYAN, more-fully described in schedule Film hereunder, in Satellite channels, Youtube, any OTT Platforms and Web Inernet,and all other Entertainment Channels, wherein the Plaintiff has the exclusive rights/copyright over the Title SAAMANIYAN , and no other Person/s have the said right over the specific Title.
b) to direct the 1st Defendant to pay the cost of the suit.
c) to grant such further or other relief/s as are just and necessary in the circumstances of the case.

JUDGMENT
The present suit had been filed for the following reliefs:-

2. It is to be noted that an application for interim protection had also been sought for but had been dismissed by this Court on 22.03.2023 made in
O.A.No.61 of 2023 in the instant suit. It is further brought to the notice of this Court that the film had been released as early as in the year 2024 and in that regard, the prayer sought for by the plaintiff had become infructuous. The plaintiff had not taken any steps in the manner known to law for the amendment of the reliefs.
3. In view of the same, invoking Order XV Rule 1 of CPC, this Court is of the view that there is no issue to be adjudicated in the present suit.
Accordingly, the suit stands dismissed. No costs.
