But the European ruled India from Europe and their agents (board of control in EIC, governers of provinces, governor general, viceroys etc) are ruled as foreigners and they never assimilated into Indian society.that is why nationalism emerged to oust foreign rule in India. Therefore if you classify the citizens or aliens on any of the ground specified in Art 15 amounts to infringement of fundamental rights. The fundamental rights in Part III is not the exclusive rights of Indian citizen, but a part of the fundamental rights also applicable to non-indians or aliens including enemy countries.because rights affairs of individual person not of state affairs except for simple governance.when large scale Continueous agitation against the parliament made law, then the Will of people shall prevail over such law. But when the question arises between THE PEOPLE – Vs – THE CONSTITUTION then Constitution shall prevail over the people. these two comparisons need to be decided on the basis of sovereignty power between the state Citizen and government.
