[04/07, 17:48] Sekarreporter: Madras High Court Division Bench confirms order of single judge upsetting appointments of Deans in Government Medical Colleges in the State.

The Division Bench comprising of Hon’ble Mr. Justice R. Subramanian and Hon’ble Mr. Justice K. Surender agreeing with the submissions of senior counsel Mr. Isaac Mohanlal held that the ‘act of court shall prejudice none’ and the writ petitioners are entitled for promotion as Deans of Government Medical Colleges in the State.

The court held that it is not in dispute the writ petitioners are ranked above some of the promotees in the common seniority list and the delay in giving promotion orders as Professors to them is attributable to an oral interim order of the Court and later administrative reasons cited by the Government due to model code of conduct coming into force at that time.

The court accepted the submission of the senior counsel that writ petitioners were qualified and they were selected for promotion and only formal orders of promotion as Professors were not issued to them on time due to supervening events and Despite that they were qualified on the date the promotion orders were issued to respondents.
