ORDER

1. The grievance in this application is regarding establishment of power looms in residential areas which according to the applicant, is causing lot of noise as well as air pollution. This Tribunal had appointed a Joint Committee and the Joint Committee has submitted the report dated Nil, e-filed on 13.12.2021 giving certain recommendations for regularizing the activities of the power loom industries suggesting certain siting criteria as well as bringing them under the consent mechanism which reads as follows:-

2. Such industries are being considered by the Department of Handloom, Handicrafts, Textiles and Khadi. So, the Principal Secretary for Handloom, Handicrafts, Textiles and Khadi is directed to file a report as to whether any policy decision can be taken to regulate the establishment of power loom in residential areas by imposing siting criteria as well as consent mechanism, as large number of complaints are coming up to the effect that such industries are causing pollution in the residential areas. So, we thought it appropriate to get their opinion on this aspect before imposing any conditions by ourselves on the basis of the recommendations made by the Joint Committee applying the
“Precautionary Principle”.
3. The 4th Respondent has filed their reply statement.
4. If the applicant wants to file any objection to the Joint Committee report, he is at liberty to file the same before the next hearing date.
5. The Registry is directed to communicate this order to the official respondents, apart from communicating this order along with earlier orders and report of the Joint Committee to the Chief Secretary, State of Tamil Nadu, Principal Secretary for Handloom, Handicrafts, Textiles and Khadi by e-mail so as to enable them to give their opinion on this aspect, though they are not party to the proceedings.
6. For filing objections (if any) to the Joint Committee report and also for consideration of the views of the Government in this regard, post on 27.01.2022.
