This Writ Petition has been filed for issue of writ of mandamus directing the respondents to disburse the bills raised by the petitioner towards extension of his professional services as a Special Public Prosecutor by considering the representation made by the petitioner on 07.02.2025.
2. Heard Mr.R.Sankarasubbu, learned counsel appearing on behalf of the petitioner, Ms.P.Aishwarya, learned Government Advocate appearing on behalf of the respondents 1 to 3 & 5 and Mr.Leonard Arul Joseph Selvam, learned Government Advocate (Crl. Side) appearing for the 4th respondent.
3. In the considered view of this Court, the petitioner who is a Senior Advocate had conducted trial in the Gokul Raj murder case and he was also requested to appear when the matter was considered in appeal before the High Court. Unfortunately, his bills have not been paid till date. The representation made by the petitioner dated 07.02.2025 also did not evoke any response. It is under these circumstances, the present writ petition has been filed before this Court.
4. The learned Government Advocate appearing on behalf of the respondents submitted that the respondents will immediately act upon the representation and settle the entire fees that is payable to the petitioner within the time frame fixed by this Court.
5. Considering the facts and circumstances of the case and the materials placed before this Court and taking note of the submissions made by the learned Government Advocate, there shall be a direction to the respondents to settle the entire fees and expenses that is payable to the petitioner for appearing before the trial Court as well as before this Court within a period of three weeks from the date of receipt of a copy of this order.
6. This Writ Petition is disposed of with the above directions. No costs.
7. Post this writ petition under the caption ‘for reporting compliance’ on 30.06.2025.
