According to the petitioner, the 4
th
respondent has issued applications
for admitting the students for the Standards 6 to 12
th
Standards. As per the
Government order, by Na.Ka.No.715/A5/2021, dated 18.6.2021, has directed the
Schools not to collect any amount except Rs.50/- from the students for admission
in the Government schools. But the fourth respondent contrary to the aforesaid
instructions, has collected Rs.100/- for each application from the parents and the
students. Petitioner being the Parent Teacher Association received complaint and
therefore, submitted a representation to the second respondent in person on
17.6.2021. He also preferred complaint to the Chief Educational Officer and other
officers through e-mail, however, no action was taken against the fourth
respondent. Therefore, he filed the present writ petition.
2. The learned Government Advocate submitted that the aforesaid
representation is not available with the second or third respondent. If the
respondents received any such representation, they will take action against any
such person after conducting enquiry. He further submitted that the writ
petitioner already filed W.P.No.9721 of 2020 challenging the show cause notice
issued by the department and the same is still pending. The present complaint as
against the 4

respondent is concerned, if any complaint received from the
parents of the students as against the fourth respondent that the 4
th
respondent

has collected money from the students, contrary to the instructions issued by the
department, the department will take appropriate action against her.
3. In view of the aforesaid submission, the petitioner is directed to
submit a copy of such representation to the third respondent within one week and
the third respondent shall enquire into such allegations and report before this
Court on or before 13.7.2021. Further, taking note of the proceedings of the Chief
Educational Officer, dated 2.6.2021 wherein it is clearly stated that school shall
not collect any amount from the students except Rs.50/- towards PTA
subscription, the Commissioner of School Education shall also send suitable
instructions to all the schools that they should not collect any excess amount from
the students and they should strictly adhered to the said proceedings failing which
appropriate action will be initiated against the Headmaster/ Headmistress of the
School concerned.
