For the purpose of recognising trade union for negotiating matters relating to workmen with management, the addition of Class I and Class II officers as voters cannot be justified
Chennai: Madras high court has ruled that all employees employed in an establishment, irrespective of their cadre and class, can become members of a trade union operating in it and participate in elections for recognition of the union.

Justice D Bharatha Chakravarthy made the observation while dismissing a plea moved by Tamilnadu Nugrporul Vaniba Kazhaga Anna Thozhir Sangam, a registered trade union functioning in the TN Civil Supplies Corporation (TNCSC), challenging the inclusion of Class I and Class II employees of the corporation in the trade union.
Relying on the provisions of the Industrial Relations Code, 2020, the judge added that a statutory provision has come into force for the first time under which the managements are duty-bound to recognise trade unions for negotiating.
