The Hon’ble Chief Justice and Hon’ble Mr Justice Senthilkumar Ramamurthy (1st Division Bench) today heard the writ appeal preferred by M.A.M. College of Engineering Trichy against the order passed in Writ Petition Number 26823/2016 dated 19-02-2020 wherein the college challenged the order imposing fine of Rs 62,50,000 for Admitting faculties to undergo P.G. Degrees during the academic years 2009-2010,2010-2011 and 2011-2012.
The Contention of the College before the High Court was that the faculties were sponsored with pay and leave to undergo P.G. Course as the AICTE insisted all faculties shall possess P.G. Degrees. Ignoring the sponsorship, grant of leave with pay and relieving the Anna University proceeded against the college and imposed fine equivalent to double the fee collected from the students while converting the full time two year course to three year part time course with a further direction not to collect any fee for the 3rd year course by the colleges from the students.
The Hon’ble First Bench appreciating the legal submissions made by
Mr. P. Ebenezer Paul and V. Krishnamurthy Advocates appeared for the college Prima Facie has taken a view that Anna University has no power under Section 5 of the Anna University Act 1978 and the Regulations framed for the Grant of Affiliation and Admitted the Writ Appeal.
Interim Stay of the order of the learned single judge was also granted and posted the Writ Appeal at the request of the counsel for the university on 24-08-2020 for further hearing.
