The Counsel for the Income Tax argued that two Show cause notices were issued to the Petitioner for which no replies were sent nor the Petitioner participated in the enquiry and hence it cannot be said that no opportunity of hearing was given .
Justice Mahadevan adjourned the case for two weeks to file Counter.
