In view of the discussion made above, the impugned judgment and decree dated 25.10.2024 passed in C.S.No.51 of 2024 is set aside. Consequently all subsequent acts including execution of sale deed made between the parties in pursuance to the auction conducted in the Court Hall are also declared as null and void. The matter is remitted back to the Trial Court to pass appropriate orders for conduct of a public auction, in accordance with law. Thus, the present Original Side Appeal stands allowed.
