[2/22, 02:22] Sivaji: I state that,the said RCOP has stopped due to conditional order are not complied,but subsequently the RCOP conditional order have complied in RCA pending on the file of VII appeallate rent control court. further the said RCOP fair trial was not conducted and no one let in evidence in wittness box and either side chief, examination, cross examination of wittnesses not conducted. the entire proceedings is lack of due process of law and not contested mater except counter.therefore it just and necessary to stay or stop proceedings of EP and consequently reopen the RCOP on the file in the interest of justice.
therefore under these circumstances it is prayed that this Hon’ble court may be pleased to stay all the proceedings in EP … and consequently reopen the RCOP no……..
there is no 11(4) application pending in RCOP before this court. this EP is not maintenable and liable to be terminated.the main reason is that the present EP araised out RCOP stopped in the mid by an order, Which is already been complied in appeal and appeallate court awaiting this record and this court not complying to do so,but unlawfully proceedings this EP without any merits other than the motivated interest of landlord/ DH by abusing the power and process of law…….
