  1. AN OPEN APPEAL TO THE BAR COUNCIL OF THAMIZH NAADU AND PUDHUCHERY

My respects to the Hon’ble chairman and the Members of the Bar council of Thamizh naadu and pudhuchery

You are well aware as how the Bar is suffering financially
You also aware that I filed a PIL as party in person in High court of Madras praying for directions to the Bar council of TN and pudhuchery for paying rupees 50,000 to the advocates from their welfare funds and Rupees 25,000 to the Regtd. Advocates clerks from their welfare funds. It is W.P 7419 filed on 30/03/2020 . It is on 16/06/2020 they were allowed by Hon’ble Mr. Justice M. Sathya Narayanan and Dr. justice Anitha sumanth. It was represented from the Bar council that for implementation it would be better that Bar council of india be impleaded. After hearing all, the hon’ble Bench inpleded the Bar council of india . All the case papers were served to the leaned counsel as well as the BCI on the very next day itself by me and the matter was posted to 01/072020 for compliance. On 01/07/2020 time was sought from your side and the matter stood posted to 22/07/2021 for reporting compliance .

2. when the mater was taken up by 2.15 pm on 22/07/2020 the learned counsel from BCI informed the Hon’ble Bench that the proceedings are stayed by the 1st Bench of Hon’ble Supreme court in the morning on the same day along with the other matters pending in other High courts .The Hon’ble Bench asked the learned counsel whether it was informed to the Hon’ble Supreme court that the matter is not pending in this High court but already disposed of .The learned counsel from the BCI could not give a clear answer .the Hon’ble bench passed a short order based on his submission and directed the Registry to send the case papers to the Hon’ble Supreme court .

3. I filed the petition in the Supreme court to dismiss the Transfer petition769 of 2020 filed by the BCI so that relates to my Writ petition is concern as mine is over and Resolution also has been passed by the Bar council of TN and pudhucery on 10/07/2020 for Recommending the Amendment to the State Governmentand giving the relief and thus within a week the Registered Advocate clerks could have got the relief and thereafter by the advocates in the State barring designated senior advocates , MPs and MLAs former and present and former government employees.
But Mr. manan kumar misra BCI Chairman and Prabakaran the Co-chairman disputed my stand before the first bench of the supreme court and the Bench rejected my request and allowed the transfer on 02/11/2020.

4. I filed a Review stating that the prayer in my Writ petition is not for begging or for bank loan and mine is only for the payments from their own welfare funds and thus nothing to do with other matters and thus the land mark judgment of the Madras High court has been frustrated and shattered into pieces and therefore is should be taken away from the Bunch that has nothing to do with the welfare fund schemes and the Madras High court judgment will be helpful for the Whole of India where welfare fund schemes for advocates and registered advocates clerks are in vogue but my Review petition No. 141 of 2021 was dismissed on 16/02/2021 saying that there is no error apparent .

5. Now, daily, advocates are contacting me to express their sufferings and I am requesting them to request the Bar Council of TN and Pudhuchery .to put an end to the suffering and I am requesting the chairman and the members of the TN and the pudhuchery to request the Bar council of India to mention before the hon’ble chief justice of india to list the matter and remove my Writ petition No.7419 of 2020 from the Bunch of the other matters so that the Madras high court could see the compliance on the Lords Directions given on 16/06/2020 and therefore I am making this open Appeal in larger interest I have requested The News papers to publish this so that the Bar members also must know the position and they can also approach the Bar council with the said request for enabling me to pursue for solution.
