Today, when the matter was taken up, Mr.A.Manikkannan, Secretary / Chief Engineer (P)/FAC, TANGEDCO appeared before this Court and filed an affidavit.

On a perusal of the said affidavit, it could be seen that in the year 2019, the Board has created a new post in the nomenclature of Gangman and proceedings have been issued on 02.03.2019 and 06.03.2019 to that effect. The nature of work of the Gangman is digging of holes for erection of poles, transportation of poles physically, stringing and erection of poles and conductors under the supervising authority and to carry out miscellaneous works as directed by the Section Officer / Supervising Authority. The nature of work of Field Assistant is to maintain uninterrupted power supply along with the other Technical Staff, maintenance works, extension works and they have to work in generation circles, transmission circles and other miscellaneous work. Therefore, the work nature of the Gangman is entirely different from the work nature of Field Assistant.

The respondents have also stated in the affidavit that the respondents have issued Notification Nos.1, 3, 4 and 5 of 2020 and Notification No.1 of 2021 inviting application through on-line from the open market for various posts totaling 5318 and in respect of Field Assistant (Trainee) it is 2900 posts. Due to the restrictions imposed to control Covid-19, the selection process has not been concluded. In the meantime, the Tamil Nadu Public Service Commission (Additional Functions) Act, 2022 (Tamil Nadu Act No.14 of 22) for filling up of vacancies in the State owned Public Sector Undertakings, State Corporation, or a Statutory Board or Authority under the control of the Government through Tamil Nadu Public Service Commission.

It is further stated in the affidavit that following the above Act, proposal was submitted to the Board seeking approval to cancel the Notifications already issued during the year 2020 and 2021 and also to fill up certain number of post including 8000 vacancies in the post of Field Assistant through TNPSC. The Board has directed to cancel the existing notification and to obtain the approval of the Government for recruitment through TNPSC.

It is further stated in the affidavit that as on date there are 23968 vacancies in the post of Field Assistant (Trainee) and after obtaining approval from the Government a proposal will be placed before the Board for its approval. On approval from the Board, the TNPSC will be requested to recruit the candidates as approved by the Government.

6. In view of the above, the respondents are directed to file additional report before this Court on 11.07.2022, intimating the time limit required to fill up the permanent vacancies. The respondents are also directed to inform about the feasibility of making appointment on temporary basis, till the permanent post are filled up, in order to reduce the hardship caused to the lower level officers and also to the public in general.
