This Court on 23.03.2021 has passed the following order:
“It is admitted before this Court that possession was not
handed over to the Tamil Nadu State Housing Board, on account
of encroachment by several persons. Despite direction issued to
the learned Additional Government Pleader appearing for the first
respondent to file a status report regarding details of the
encroachment, the same has not been filed. Though the Revenue
Officials are not made parties, the Secretary to Government is the
first respondent in the Writ Petition. Hence, there is no excuse for
any of the Revenue Officials to give instructions for the purpose
of filing status report. In such circumstances, the District
Collector, Chennai, shall file a status report before 16.04.2021. If
the District Collector, Chennai, fail to file status report, this Court
will take serious note of passing appropriate orders or directions
to the Revenue Officials for being lethargic in responding to the
Court’s directions.
List the case on 16.04.2021.”
2.Pursuant to the said order passed by this Court, today when the writ
petition is taken up for hearing, one Mrs.Abisegam, Additional Personal
Assistant for Collector, Chennai District (Land Administration), has filed a
status report of the District Collector.
3.On perusal of the said status report, this Court finds that, it is in
affidavit format filed by Mrs.R.Seethalakshmi, I.A.S., District Collector of
Chennai. However, the said report in the affidavit format has not been signed
by the District Collector Mrs.R.Seethalakshmi and in the jurat portion, the date

[4/17, 15:43] Sekarreporter1: explanation as to why appropriate action shall not be recommended to be taken
against the District Collector by the concerned authority in the hierarchy of
administration of the State Government.
7.Accordingly, there shall be a direction to the District Collector,
Chennai Mrs.R.Seethalakshmi to give explanation in writing as to why action
should not be recommended to be taken against her for having not signed the
affidavit and permitted somebody on behalf of the Collector to sign the
affidavit, which was sworn in, in the name of the Collector.
8.Post the matter on 22.04.2021.
9.Mr.M.Elumalai, learned Additional Government Pleader appearing for
the first respondent is hereby directed to take a copy of this order and
communicate the same to the District Collector for compliance.
