SYNOPSIS
The Petitioner submits that gambling is a criminal offence in India. The Petitioner submits that of late there is a spurt in suicide of youngsters in Tamilnadu due to the huge monetary loss sustained by them in the online gambling. Youngsters are being hooked to this on line gambling addiction by the organizers by providing huge cash bonus to anyone and uses the famous cricket and film personalities including cricketer like Virat Koli and actress Tamanna who brain wash these young with their powerful appeal to join this game. What initially started as a time pass subsequently it becomes a habit and further develops to gambling addiction and these young who sustain heavy monetary loss and borrows loan from money lenders at usurious rate of Interest to gamble and unable to pay back the debt and no other choice than to commit suicide. The Petitioner submits that online gambling is a menace to the society like blue whale game which forced several students to commit suicide and the Madurai Division Bench of the Madras High Court has taken suo moto Cognizance of the same and banned the game in India and further directed the authorities to Initiate necessary legal action to stop this menace. But this gambling addiction is more dangerous to the society and violative of art 21 of the Constitution of India as it infringes right to life. Hence this writ petition seekingban.

the interest of youths of this country whose future and career and right to life with dignity is affected by the unrestricted and unlawful online gambling I am filing this Writ Petition as a Public Interest Litigation by way of directing the respondents to close all such gambling online sites and arrest and prosecute all the offenders of running online gambling sites and the film and other personalities who hook youngsters, to this evil illegal gambling and for the offences of abetment to commit suicide and for promoting gambling under Article 226 of the Constitution of India.
3) I submit that this unethical and immoral online gambling is being promoted online by various anti social elements promising the citizens with initial Bonus of several thousands and to hook these innocent youngsters they engage the services of cricketers like Virat’s Koli and glamorous actresses like Tamanna to hook these innocent youngsters to play gambling. These modern day sagunees like Koli and Tamanna are constantly pressuring and brain washing our youngsters to fall in the trap of this evil gambling and appears to be taking psychological like control of the victims of the game to earn crores as their appearance fees which is nothing but a blood money to hook the youth to this unfortunate trap of gambling.
4) I submit that initially the youngsters fall into the gambling by playing the gambling with the initial bonus being

offered by these unscrupulous people and subsequently started to spend their hard earned money or the hard earned savings of their family members knowingly or unknowingly affect of such family members. After losing heavily and unable to raise any further resources within their house these youngsters are forced to borrow at exorbitant rate of interest and in some cases they go to the extent of committing crime to raise money to gamble. Subsequently, when they are not able to return or repay the debt they commit suicide.
5) I submit that considering the fact that these gambling promoters are paying in crores to these cricket players and actresses, to hook youngsters, it can be safely presumed that lakhs and lakhs of our youngsters have been successfully hooked into the evil practice of gambling by people like Virat Koli and Tamanna several youngsters who were hooked into this gambling have committed suicide recently on 28th August 2020. Mr. Vignesh, a 19 years old college student of Chennai has committed suicide by hanging himself and left a suicide note, blaming his addiction for online gambling for his suicide.
6) I submit that even though the government authorities are well aware of this sorry state of affairs ,they have failed to ban these on line gambling sites as they did in the case of killer “blue

whale game “after the Madurai Bench of the Hon’ble High Court took suo moto cognizance and issued directions, directing the government to immediately block and close the blue whale game online site.
7) I submit that this online gambling sites are more dangerous than the blue whale game as by getting addicted to this gambling, the victim not only spend his money but also spend their family members’ money and put them in financial burden while in the case of blue whale, the victim alone suffer.
8) I submit that in the interest of society and to protect the honour and dignity of our youngsters and further to protect the life as guaranteed under Article 21 of the Constitution of India, it is just and necessary that authorities have to be immediately directed to close all online gambling sites forthwith and arrest and prosecute Virat’s Kohli and Tamanna for their role in abetting the youngsters to gamble online as playing and abetment to play gambling is a criminal offence.
9) I have no other efficacious and alternative remedy except to approach this Hon’ble Court by invoking Article 226 of the Constitution of India. Hence the Writ petition.

Chennai: Moved by several youngsters getting hooked to online gambling and also one youth committing suicide, a lawyer has filed a public interest litigation petition in the Madras High Court seeking a direction to shut down online gaming sites, arrest and prosecution of promoters and the brand ambassadors.

The petitioner has also sought a direction to arrest and prosecute cricketer Virat Kohli and actor Tamannaah for their role in abetting the youngsters to gamble online as playing and abetment to play gambling is a criminal offence.

Queried on the rationale of his plea for arrest and prosecution of Kohli and Tamannaah as they are just paid brand ambassadors

A.P.Suryaprakasam, the petitioner told IANS: “They are the major influencing factor. Gambling is evil and they are promoting it. As a matter of fact, the amended Consumer Protection Act has a provision that for false advertisements the brand ambassadors are responsible.”

According to him, the brand ambassadors cannot wash away their hands saying that they are just paid performer – just like an arrow while the archer is the wrongdoer.

“The online gaming addict after sometime resorts of domestic violence to raise money or heavy borrowing to play,” Suryaprakasam said.

“No other sports body promotes the game saying the earning potential. When there is a monetary element involved in a game then it is nothing but gambling,” Suryaprakasam said.

In the petition, he had said online gambling sites are more dangerous than the blue whale game as by getting addicted to this gambling, the victim not only spends his money but also spend their family members’ money and put them in a financial burden while in the case of blue whale, the victim alone suffers.

He said the Madurai Bench of the Madras High Court suo moto took up a case against the blue whale game and directed the government to ban it.

Suryaprakasam said initially the youngsters fall into the gambling lured by the initial bonus being offered by these unscrupulous people and subsequently started to spend their hard-earned money or the hard-earned savings of their family members knowingly or unknowingly affect of such family members.

Subsequently, when they are not able to return or repay the debt they commit suicide,” he said in his plea.

Recently, the Madurai Bench of the Madras High Court suggested to the Tamil Nadu government that it enact suitable laws to regulate the online gaming industry.

Citing the laws against lottery and charging of usurious interest enacted by the Tamil Nadu government, the court hoped that it will also take note of the present alarming situation and pass suitable legislation to regulate and control online gaming through license, keeping in mind the law of the land as well as the judicial precedents in this regard.

Explaining the modus operandi of online games, the court had said: “If X and Y want to play a game, both of them have to bet a sum of, say, Rs 10. The winner will get the amount that he put in place, ie., Rs 10 and in addition to that, he will get an additional sum, say 75 per cent, that was put in place by the opponent, being the prize amount. The balance, ie., 25 per cent, will be credited to the account of the particular online gaming site. The loser will lose everything.”

“If a group of persons say 10, want to play a game, each one of them have to bet a sum of Rs 10. At the end of the game, the winner will get his amount as well as 100 per cent of his bet amount, being the prize money. The runner-up will get his amount as well as 70 per cent of his bet amount, being the prize money. The losers will not only lose the game, but also Rs 10 that was put in by them.”

A rough calculation for the aforesaid scenario, the court said, will give a whopping sum of Rs 63 to the online gaming site, while awarding Rs 20 to the winner and Rs 17 to the runner. Naturally, a player, if he loses his amount, will try to meet out his loss by playing again and again, it added.

The court cited laws of various states regulating online gaming, including the Telangana Gaming (Amendment) Act 2017 that prohibits all forms of gaming for money, be it games of skill or games of chance.

“In fact, the Government of Telangana has further moved a Bill to amend the Telangana Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug-Offenders, Goondas, Immoral Traffic Offenders and Land-Grabbers Act, 1986, by including ‘Gaming Offender’, who commits or abets the commission of offences punishable under the Telangana Gaming Act, 1974,” the court said.

The Tamil Nadu Police had also told the court about absence of laws in taking action against online rummy in the state.
