Today the Honorable High court of Madras has pronounced its verdict against the bail application preferred by C.S.Karnan

 

 

 

 

. The Honorable Mr. Justice V.Bharathidasan through his order to the batch of Crl.O.P’s stated that the petitioner is found to have carried out all the maligned activities and that the gravity of the offence is also very serious. Mr G Rajagopalan Learned Senior Counsel appearing on behalf of C S Karnan contended that he is not arguing the bail application on merits and admitted that petitioner released all the alleged videos and he further contended that all such objectionable videos were uploaded when he was under severe mental depression pursuant to the order passed by Supreme Court on suo moto contempt. Moreover Learned Senior Counsel Mr.S.Prabakaran appearing on behalf of the intervener namely The Bar Council of Tamil Nadu and Puducherry opposed strongly stating that the petitioner uploaded objectionable and hateful video that are scandalous, obscene, very vulgar and vituperative statements maligning the Integrity of the institution, the integrity of the Former Judges of the Supreme court of India and the former Judges of the High court, the member of Bar council of India. Furthermore when considering the past conduct of the petitioner there is every likelihood that the offences can be repeated in the event of releasing him on bail. Therefore the honorable court is unable to accept the undertaking given by the petitioner. Moreover the Honorable High court stated that the petitioner being a former judge and also a founder president of a political party appears to be very influential. Considering the position held by the petitioner as a constitutional functionary and being very influential the honorable court is of the view that if the petitioner is released on bail then there is every possibility of the petitioner interfering with the investigation and tampering with the witnesses and influence officials thereby denying bail in all the crl. O.P’s as prayed by the petitioner.
