[6/5, 14:17] Sekarreporter 1: Today 5.6.2020, HCP filed by mother of Nalini (Life convicts prisoners in Ex Prime Minister Rajiv Gandhi assasination case) was listed as item no.17 before the hon’ble bench consisting of His lordship Mr Justice Kirubakaran and Her Lordship Mrs.Hemalath. Prayer sought in the HCP was that seeking permission of the court for Sri Murugan and Nalini to make video from the prison to UK where the mother of murugan is residing and to Sri Lankan where sister of Murugan is residing. This is for the reason during this pandemic situation, father of murugan died and for condolence purpose this permission is sought for by the two prisoner. In the prayer they are seeking permission to make video call daily for 10 minutes. Mr.A.Natarajan State Public Prosecutor appeared for the State and Mr.Radhakrishnan appeared for the Petitioner. State PP informed the hon’ble court that Murugan is an sri lankan citizen hence a foreigner and there is no provision in law or in tamil nadu prison rule to allow either indian prisoner or foreign prisoners to make any foreign calls. Even as per rule no provision is available to the prisoners to make both normal call as well as video call to foreign countries. State PP also informed that the Ministry of External affairs should be impleaded by this hon’ble court since they are the right party to inform this hon’ble court regarding international calls and foriegn prisoners rights.The state PP relied upon a GO of tamilnadu government but the counsel for petitioner informed that he doesnt have the said GO so the hon’ble court directed the State PP to furnish the said GO and other documents relied by him to the petitioners counsel. The hon’ble court also informed the State PP to get instruction from the government whether these prisoners can be allowed to talk to their mother and sister of murugan for condolence only on humanitarian ground. State PP informed that on next hearing he will get instruction according to the courts view. Hence case adj to 12.6.2020.
