l. H Krishnanunni, A S Slov Harikumar, aged about 34 years, now working as District Collector. Erode District. Erode do hereby solemnly affirm and sincerely state as follows
1. I am the fourth respondent in this case. As such, I am well acquainted with the facts and circumstances of the case.
2. The Honourable High court of Madras passed an order in W.P.No.1830/2022 on 08.02 2022 with a direction, to implement the District Gazette Notification issued by the District collector, Erode dated:07.01 2019. The Notification was implemented on 10 02.2022 and thereby, the Heavy Vehicles were not permitted to ply on the National Highway (NH 948) in the stretch of the Sathyamangalam Tiger Reserve between 6.00 p m to 6.00 a.m, and the Light Commercial Vehicles were also not permitted between 9.00p.m to 6.00 a.m. Many complications were faced by the public as well as the Government Departments after the implementation of Night ban. The above problems were submitted before the Honourable High Court and after a detailed discussion Honourable High Court passed an Interim Order on 02 03.2022 to get suggestions from the petitioners in order to regulate the traffic on the road falling in the Tiger Reserve, The District
Administration has given a written instruction to the petitioners to submit their representations within a period of three days from the receipt of the interim order The following petitioners submitted their suggestions to the District administration,

It is respectfully submitted that suggestions received from the petitioners pertaining to WP 1830 of 20221 wp 1832 of 2022, wp 41090f 2022 and 4130 of 2022 are as follows.
Suggestions Of Thiru,SP. Chockalingam, Advocate, who is the petitioner in WP 1830 of 2022 and W.P.1832 of 2022 .
I ) Ban on night traffic in the National Highway NH 948 within the tiger reserve. for the time period between 9.00 PM to 6 00 AM in the cases of Light Motor Vehicles and for the time period between 6 00 PM to 6.00 AM in the cases of heavy vehicles should compulsorily be implemented.
2) Emergency vehicles like ambulance, fire engines etc., may be allowed without restraint even during night time.
3) Permits / passes should be issued to local people by the forest department to use the highway within the tiger reserve allowing them to attend, during the occasions of functions / ceremonies I funerals and other festivals with an exemption from paying toll.
4) In order to avad traffic snarls / congestion in check posts of the highway passing through the tiger reserve, all vehicles be exempted from payment toll and speed restrictions should be imposed
5) Vehicles should not be allowed to be parked inside the Tiger Reserve. Without cause the drivers/cleaners / passengers should not be allowed to alight from the vehicles in the tiger reserve and Food items and food wastes should not be discarded in the tiger reserve.
6) Weighbridge and load height measures should be in place to check violations and Cameras at appropriate places may be installed in the stretch in order to monitor the strict enforcement which also may be kept in surveillance with the help of Patrol vehicle.
Suggestion of the President of Sathyamangalam Lorry Owners Association t Since the petsons depending on transport services are affected to a greater extent due to ban on night traffic in the ghat road. humbly request to allow the vehicles as before
Sadden rush by vehicles wading tot the release of the traffic, leads to more trattte congestions And while allowing two way traffic from both the check posts at the same tinne leads to accidents,

It is respectfully submitted that, in the meeting, as Instructed by the Honourable High Court, various issues faced by the local people and traders: the issues related to the movement of the wild animals as well as the problem of traffic_ Suggestions are placed before the H’ble courts kind consideration Of appropriate orders
• From 6.00 P.M to 5.00 A.M, any vehicle which is more than a 6 wheeler may not be allowed to ply in the stretch of Sathyamangalam Tiger Reserve.
• From 10.00 P.M to 5.00 A.M. night traffic ban to be implemented except for
a), Medical emergency vehicles like ambulance (Government/ Private), Public transport vehicles of any type may be allowed to ply in the stretch of Sathyamangalam Tiger Reserve without restrictions.
b). Local people may be allowed to travel in the stretch of Sathyamangalam Tiger Reserve without any time restriction. subject to verification of proof of local residence.

c). The transportation of perishable agricultural produces like fruits vegetables, flowers, Milk and Milk products may be relaxed from the existing restriction to ply during the Night hours, subject to verification at check points.
• The collection of entry fee in the National Highway should be done only after getting the prior approval from the MoRT&H. This Prior approval was not sought in this instance So, as per the suggestions received from the petitioners and stakeholders, the Collection of fees may be stopped with immediate effect. Since. it is now being levied without the prior approval from the MoRT&H
• There is an alternate route from Anthiyur to Kargekandi (via Burgur), which at present, has motorable difficulties due to recent land sliding. The movement of vehicles may be permitted after the permanent restoration of this route
• In order to regulate the speed of the vehicles plying in the Ghat Road. adequate number of speed breakers may be further constructed in the Accident Prone Zone and Animal Road Kill Zone by Concerned Departments as per the Rules in force
• Adequate Road Safety Infrastructure may be installed along the stretch to prevent accidents.
It is respectfully submitted that, to implement the above in the interest of public as well as stakeholders, it is necessary to make amendments in the Erode District Gazette Notification dated: 07.012019.
It is respectfully submitted that as per the suggestions received from the petitioners / stakeholders detailed above and based on the decisions made by the State Government the stated conditions and to that extent the necessary modifications of the District Gazette, may be allowed in the interest of the livelihood of the public and thus render Justice,

சென்னை, மார்ச் 11: ஈரோடு சத்தியமங்கலம் புலிகள் சரணாலயம் சாலையில் அந்த பகுதியில் வசிக்கும் பொதுமக்கள் பயணிக்க எந்த தடையும் இல்லை என்றும் இரவு 10 மணி முதல் காலை 5 மணிவரை ஆம்புலன்ஸ் உள்ளிட்ட அவசர வாகனங்கள் தவிர எந்த வாகனத்திற்கும் அனுமதி இல்லை என்று தமிழக அரசு உயர் நீதிமன்றத்தில் அறிக்கை தாக்கல் செய்துள்ளது.

வனவிலங்குகள் நல ஆர்வலரும், வழக்கறிஞருமான சொக்கலிங்கம் உயர் நீதிமன்றத்தில் தாக்கல் செய்திருந்த மனுவில், ஈரோடு மாவட்டத்தில் உள்ள சத்தியமங்கலம் புலிகள் சரணாலயத்தில் புலிகள் மட்டுமின்றி சிறுத்தை, யானை, மான், காட்டெருமை போன்ற விலங்குகளும் உள்ளது. இந்த சரணாலயத்தின் வழியே பெங்களூரு செல்லும் சத்தியமங்கலம் தேசிய நெடுஞ்சாலையில் வாகனங்கள் மோதி வனவிலங்குகள் அடிக்கடி பலியாகின்றன. இந்த சாலையில் 24 மணி நேரமும் கனரக வாகனங்களும், இலகு ரக வாகனங்களும் என தினமும் 5000 வாகனங்கள் வரை செல்கின்றன. கடந்த 2012 முதல் 2021 வரை 8 சிறுத்தைகள், ஒரு யானை, 71 மான்கள், 55 மயில்கள் என 155 வன விலங்குகள் வாகனங்கள் மோதி பலியாகியுள்ளன. எனவே மாலை 6 மணி முதல் காலை 6 மணி வரை கனரக வாகன போக்குவரத்துக்கும், இரவு 9 மணி முதல் காலை 6 மணி வரை பிற வாகன போக்குவரத்துக்கும் தடை விதிக்க வேண்டும், என கோரியிருந்தார்.
இந்த வழக்கை விசாரித்த தலைமை நீதிபதி முனீஷ்வர் நாத் பண்டாரி மற்றும் நீதிபதி டி.பரதசக்ரவர்த்தி ஆகியோர் அடங்கிய அமர்வு, சத்தியமங்கலம் புலிகள் சரணாலயத்தின் வழியாக செல்லும் தேசிய நெடுஞ்சாலையில் வரும் பிப்ரவரி 10ம் தேதி முதல் மாலை 6 மணி முதல் காலை 6 மணி வரை வாகன போக்குவரத்துக்கு தடை விதித்து மாவட்ட ஆட்சியர் பிறப்பித்த உத்தரவை கண்டிப்புடன் அமல்படுத்த வேண்டும் என்று உத்தரவிட்டனர்.
இந்த நிலையில், இந்த வழக்கில் ஈரோடு கலெக்டர் கிருஷ்ணன் உண்ணி தாக்கல் செய்துள்ள அறிக்கையில் கூறியிருப்பதாவது:
உயர் நீதிமன்ற உத்தரவின்படி கடந்த மாதம் 10ம் தேதி முதல் சத்தியமங்கலம் புலிகள் சரணாலய சாலையில் மாலை 6 மணி முதல் மறுநாள் காலை 6 மணிவரை வணிக வாகனங்கள் செல்ல தடை விதிக்கப்பட்டுள்ளது. இதனால் பொதுமக்கள் கடுமையாக பாதிக்கப்பட்டுள்ளனர். வழக்கு தொடர்ந்தவர்களிடம் ஆலோசனை பெற வேண்டும் என்று நீதிமன்றம் அறிவித்ததன் அடிப்படையில் ஆலோசனை நடத்தப்பட்டது.
அதன்படி மனுதாரர்கள், அந்த சாலையில் இரவு 9 மணி முதல் மறுநாள் காலை 6 மணிவரை இலகு ரக வாகனங்களுக்கும் மாலை 6 மணி முதல் காலை 6 மணிவரை கனர ரக வாகனங்களுக்கும் தடை விதிக்கலாம் என்றும் ஆம்புலன்ஸ், தீயணைப்பு வாகனங்களுக்கு விலக்கு அளிக்கலாம், வாகன நெரிசலை தவிர்க்க அந்த சாலையில் டோல் கட்டணம் வசூலிக்க விலக்கு அளிக்கப்பட வேண்டும், 16.2 டன்னுக்கு மேல் சரக்குகளை கொண்டு செல்லும் வாகனங்களை தவிர மற்ற வாகனங்கள் 20 கிலோ மீட்டர் வேகத்தில் செல்ல அனுமதிக்கலாம், தாளவாடி பகுதியில் வசிக்கும் மக்களுக்கு சாலையை பயன்படுத்துவதில் விலக்கு அளிக்க வேண்டும் என்று ஆலோசனை தெரிவித்துள்ளனர்.
இதையடுத்து, சுற்றுச்சூழல் துறை, நெடுஞ்சாலை துறை முதன்மை செயலாளர்கள், தலைமை வனக்காப்பாளர், கூடுதல் அட்வகேட் ஜெனரல் ஜெ.ரவீந்திரன் உள்ளிடோர் அடங்கிய அதிகாரிகள் கூட்டம் கடந்த 5ம் தேதி நடந்தது. அதில் ஈரோடு கலெக்டர், கோபி நெடுஞ்சாலை துறை மண்டல பொறியாளர் உள்ளிட்டோரும் பங்கேற்றனர்.
இந்த கூட்டத்தில் அந்த பகுதி மக்களின் பிரச்னைகள், வாகன நகர்வு, வாகன நெரிசல் ஆகியவை குறித்து ஆலோசிக்கப்பட்டது. கூட்டத்தில், ” மாலை 6 மணி முதல் மறுநாள் காலை 5 மணிவரை 6 சக்கர வாகனங்கள் தவிர மற்ற வாகனங்களை இயக்க அனுமதிக்கலாம், இரவு 10 மணி முதல் காலை 5 மணிவரை மருத்துவ அவசரம், பொது போக்குவரத்து வாகனங்கள் தவிர மற்ற வாகனங்களுக்கு அனுமதி இல்லை.

அந்த பகுதி மக்கள் எந்த நேரத்திலும் உரிய அடையாள அட்டையுடன் அந்த சாலையில் செல்லலாம், காய்கறிகள், பழங்கள், பால் மற்றும் பால் பொருட்கள் இரவு நேரத்தில் செல்லலாம். ஒன்றிய சாலை போக்குவரத்து அமைச்சகத்திடம் உரிய உத்தரவு பெற்ற பிறகு சாலை நுழைவு கட்டணத்திற்கு விலக்கு அளிக்கப்படும். இருந்தபோதும் மனுதாரர்களின் கோரிக்கையின் அடிப்படையில் தற்போது உடனடியாக கட்டண விலக்கு அமல்படுத்தப்படவுள்ளது.
மாற்று பாதையான அந்தியூரிலிருந்து கர்கேகண்டி சாலை தற்போது நிலச்சரிவால் பாதிக்கப்பட்டுள்ளது. அந்த சாலை சீரமைக்கப்பட்ட பிறகு வாகனங்கள் செல்ல அனுமதிக்கப்படும்.
புலிகள் சரணாலய சாலையில் வேகத்தை தடுக்க போதுமான வேகத்தடைகள் அமைக்கப்படும்” என்று முடிவெடுக்கப்பட்டுள்ளது. இந்த திட்டத்தை செயல்படுத்த ஈரோடு மாவட்ட அரசிதழில் திருத்தம் கொண்டுவரப்படும்.
இவ்வாறு அந்த அறிக்கையில் கூறப்பட்டுள்ளது.
