The Hon’ble High Court on 30.4.2021 quashed the Sealing and ban order ,Electricity Disconnection order issued to 186 brick kilns in coimbatore by the Tahsildar

[5/1, 13:56] Sekarreporter1: The Hon’ble High Court on 30.4.2021 quashed the Sealing and ban order ,Electricity Disconnection order issued to 186 brick kilns in coimbatore by the Tahsildar after hearing the Arguments of Senior Advocate P. Wilson and other counsels in batch of matters.
Hon’ble Mrs Pushpa Satyanarayanan also directed to conduct enquiry by District collector with in 4 weeks after affording opportunity to the brick Klin manufacturers .
Brick kilns are located in 5 village panchayats viz Chinna Thadagam, Veerapandi, Pannimalai, Nanjundapuram, Somayar Palayam in coimbatore districts and this cottage industries are there for last 40 years.
Due to change in law in 2002, the licenses have to be necessarily obtained from Distrct collector under the TN minor mineral concession Rules. The District collector coimbatore was issuing licenses in form I all these years to these brick Klin operators.
However since last few years licences were not issued but licence fees were collected yearly from the manufacture of bricks from brick kilns .
Last year a PIL was filed claiming that brick kilns are operated in government lands in elephant path ways. The Hon’ble first bench on 10.2.2021 directed to take action if it is on elephant pathway.
The Tahsildar as a knee jerk reactions by his order dated 19.3.2021 ordered closure of all brick kilns and disconnected power supply and sealed the premises even without hearing the operators.
These brick kilns are operated in Pattah lands and the manufactures were residing in the same places. The forest department later on filed a counter stating that these bricklins are not located in the elephant corridors.
The learned judge found that District collector collected license fees without any hesitation but not issuing license to these Brock Klin operators .
