The principal matter is the petition filed in the year 2019 on
which an injunction subsists and, by an order dated July 19, 2021, the
views of the Tamil Nadu Pollution Control Board were sought upon
expert scientific opinion being obtained. It is submitted on behalf of
the official respondents, including the TNPCB, that the matter has been
referred to the National Environmental Engineering Research Institute
(NEERI) and NEERI has said that a study has to be conducted and a
minimum of six months would be required before any report can be
furnished.
2. Some of the concerns which may have been engaged in the
quarrying business or were intending to commence such business upon
obtaining due permission and sanction from the appropriate authorities
are said to be seriously prejudiced by the subsisting injunction.
According to such entities, they are out of pocket upon having acquired

their permits, though several others were found to have obtained
permission for engaging in such activities. It is submitted by learned
Government Pleader that a preliminary report may be filed since
several entities have been stopped from carrying on any further
quarrying activities. The status report should be filed before the matter
appears next.
5. Both petitions will appear in the second week of December,
2021 to decide on the further course of action based on the reports
pertaining to the study conducted by NEERI and the one pertaining to
the quarrying activities undertaken in Krishnagiri District.
