The Division Bench of Honble Justice R Subramanian and Honble Justice kalai Mathi disposed of the Appeal filed by Enforcement Directorate against TTV Dinakaran holding that the Order of Adjudication of Rs 28 crores against TTV Dinakaran will be a debt within the meaning of Insolvency Act and TTV Dinakaran will be a Debtor and Government of India will be a Creditor for the said amount and Insolvency laws applies for the said outstanding amount which TTV Dinakaran has failed to pay. While confirming that the old insolvency notice which was issued is set aside as it was issued when the order of adjudication at that point of time had not become final, the Bench has held it is open to the Government of India to issue fresh insolvency notice for the defaulted amount of Rs 28 crores.
