AFFIDAVIT OF THE PETITIONER

I, Prabhu @ Bullet Prabhu, Son of Late.Selvam, Hindu, aged about 33 years, residing atAshok Bhavanam, Ramaiah Street, Jaihindpuram, Madurai South, Subramaniapuram, Madurai – 625 011, do hereby solemnly affirm and sincerely state as follows:-

1. I am the petitioner herein and as such I am well acquainted with the facts of the case.

2. I respectfully submit that I belongs to Pandaram Community falls under Backward Class Community and AndiPandaramin the Sl.No.2 in the recent Tamil Nadu Special Reservation of seats in Educational Institutions including Private Educational Institutions and of appointments or posts in the services under the State within the Reservation for the Most Backward Classes and Denotified Communities Act, 2021 and thereby, we have granted only 2.5% reservation among the Most Backward Class Community.

3. I am filing this writ petition purely on the public interest at my own cost and if this Hon’ble Court found that, any private interest is involved, I am ready to pay any cost if awarded, by way of order if passed by this Hon’ble Court in the above case.

(a) This writ petition is filed for common cause to protect the image of our community people and discrimination by caste by using our community name in public with defamatory words in the lyrics of the 2nd respondent’s movie and absolutely there is no personal interest and hereby endorse the same.

(b) I am a flower garland vendor belong to aeconomically weaker class society, I file this writ petition in my individual capacity as a public spirited person.

(c) I have not filed any Public Interest Litigation earlier. If this Hon’ble Court find that the writ petition is not filed for public interest, I am ready to pay any cost amount imposed by this Hon’ble Court.

(d) I am not an income tax assesse and I am paying the expense for this writ petition out of my own fund.

4. I respectfully submit that our community people were spread over all the Districts in Tamilnadu and we have individual Association in all the Districts either in the name of Andipandaram or in the name of our sub caste viz., Jangam, Jogi and Yogeswarar, all falls under Most Backward Class. We have been called in the name of Pandaram since time immoral as, we indulge in the work of protecting temples and temples properties. After the independence, our community people has not given any preference / reservation and by virtue of the same, our community people had gone down economically, educationally and became a part of economically weaker society people. As on date, our community people commonly do “Poojariship” in all the village temple and sell “Flower Garlands”. We also have state wide representing body in the name of TamilnaduVeerasaivarPeravai (combined body of all our sub castes).

5. I respectfully submit that in the recent past, I come across a teaser published under the title “KARNAN-KandhaVaraSolunga” both in Audio form and Visual form certified by the 1st respondent vide “U” Certificate Nos.DIS/1/118/2021-CHE, VIZ/1/124/2021-CHE and VIZ/1/126/2021-CHE all dated 19.02.2021 on the application of the 2nd respondent, claiming to be a Producer of an upcoming film directed by the 3rd respondent under the title viz., “KARNAN”. Along with the said teaser, two songs titled as PandarathiPuranam was also released by the 2nd respondent under the certificate granted on 19.02.2021. In the said lyrics of the song, continuously the content of the song especially the lyrics clearly defame our community as well as community womens by calling “gz;lhuj;jp” vd; ‘rf;fhyj;jp” which is a clear defamation on our community. The said song was widely published in You Tube Channel owned by the 4th respondent.

6. I respectfully submit that as per the guidelines issued by the 1st respondent under Section 5B(2) of Cinematograph Act, 1952 (37 of 1952), the lyrics of the 2nd respondent’s movie clearly cause defamation to our community people at large and therefore, the same should not be allowed to broadcast / release in his upcoming movie titled as “KARNAN” scheduled on 9th April, 2021.

7. I respectfully submit that similarly, in a TV Channel viz., ZEE TAMIL, Drama Serial was telecasted under the title “SEMBARUTHI” and in which, similarly, defamatory sentence was engaged between a character continuously as “THINNI PANDARAM” and the same was challenged by me before the Broadcasting Content Complaints Council (BCCC), formulated under the parent organization viz., Indian Broadcasting Foundation (IBF) against the said channel and obtain order at S.No.103 under the BCCC proceedings. The same is well available in the official website of IBF viz., https://www.ibfindia.com/.

8. I respectfully submit that no doubt, the lyrics of the aforesaid song titled as PandarathiPuranam Song-1, Song-2 annoyed our community people since from the date of release and the 1st respondent being authority to certified such video miserably failed to follow the guidelines issued under Cinematograph Act, 1952 (37 of 1952) and therefore, the same clearly attract Article 15 of Constitution of India, discriminating our community people in the name of caste in the entire lyrics cannot be allowed and the same should be banned immediately. Hence, I have come forward with this writ petition seeking to declare the “U” Certificate Nos.DIS/1/118/2021-CHE,VIZ/1/124/2021-CHE and VIZ/1/126/2021-CHE all dated 19.02.2021 as per-se illegal and the same is liable to quash among the following other

GROUNDS

(A) The impugned certificates issued by the 1st respondent in favour of the 2nd respondent under the title “KARNAN-Lyrical Video Song-1 (KandhaVaraSolunga)”, “KARNAN-Lyrical Digital Song-1 (KandhaVaraSolunga)” and KARNAN-Teaser all dated 19.02.2021 is against the very Guidelines issued under Section 5B(2) of Cinematograph Act, 1952 (37 of 1952) and therefore, the same is liable to quash as illegal.

(B) The 2nd respondent’s song titled as PandarathiPuranam Song-1, Song-2 annoyed the petitioner’s community people, from the date of release i.e., on 31.01.2021. However, the certificate for such “KARNAN-Lyrical Video Song-1 (KandhaVaraSolunga)”, “KARNAN-Lyrical Digital Song-1 (KandhaVaraSolunga)” and KARNAN-Teaser issued by the 1st respondent only on 19.02.2021. Therefore, the 2nd respondent, illegally released the same in their You-tube Channels viz., “Think Music India” and “KalaipuliS.Thanu” and therefore, it is must and necessary to issue an interim direction as prayed for.

(C) The contents of the 2nd respondent song’s, lyrics titled as PandarathiPuranam Song-1, Song-2 clearly defame the petitioner’s community people especially the womens of the petitioner’s community people as “gz;lhuj;jp” vd; ‘rf;fhyj;jp” which is a clear defamation and discrimination under Article 15 of Constitution of India. The same should not be allow and therefore, the same should be banned permanently in the full movie titled as KARNAN scheduled to be released on 09th April, 2021.

(D) The 1st respondent being authority to certified such video ought to have followed the Guidelines issued under Cinematograph Act, 1952 (37 of 1952). Hence, the petitioner has come forward with this writ petition seeking to declare the “U” CertificateNos.DIS/1/118/2021-CHE, VIZ/1/124/2021-CHE and VIZ/1/126/2021-CHE all dated 19.02.2021 as per-se illegal and the same is liable to quash.

9. In these circumstances, and in the interest of justice, I have approached this Hon’ble Court by invoking Article 226 of constitution of India, as I have no other alternative and efficacious remedy and I have not filed any other writ petition seeking similar relief.

I respectfully submit that the impugned certificate issued by the 1st respondent in favour of the 2nd respondent not served to anyone except the 2nd respondent and therefore, I have come forward with the certificate downloaded from the official website of the 1st respondent and therefore, the production of the original impugned “U” Certificate Nos.DIS/1/118/2021-CHE, VIZ/1/124/2021-CHE and VIZ/1/126/2021-CHE all dated 19.02.2021 may be dispense with, for the time being.

It is therefore prayed that this Hon’ble Court may be pleased to DISPENSE WITH the production of the original impugned “U” Certificate Nos.DIS/1/118/2021-CHE, VIZ/1/124/2021-CHE and VIZ/1/126/2021-CHE all dated 19.02.2021 for the time being and thus render justice.

It is therefore prayed that this Hon’ble Court may be pleased to pass an order of INTERIM INJUNCTION restraining the 1st respondent from issuing any certificate for the movie “KARNAN” on the application of the 2nd respondent, pending disposal of the above writ petition and thus render justice.

It is therefore prayed that this Hon’ble Court may be pleased to pass an order of INTERIM DIRECTION directing, the 2nd and 4th respondents to forthwith remove the content relating to PandarathiPuranam under the title “KARNAN” from their You Tube Channels viz., “Think Music India”and “KalaipuliS.Thanu”, pending disposal of the above writ petition and thus render justice.

It is therefore prayed that this Hon’ble Court may be pleased to issue a WRIT OF CERTIORARIFIED or any other writ, calling for the entire record pertaining to the impugned CertificatesNos.DIS/1/118/2021-CHE, VIZ/1/124/2021-CHE and VIZ/1/126/2021-CHE all dated 19.02.2021issued by the 1st respondent under the category “U- Unrestricted Public Exhibition” in favour of the 2nd respondent and quash the same as perse illegal and pass such further or other orders as this Hon’ble Court may deem fit proper in the circumstances of the case and thus render justice.
