CHENNAI: The Madras High Court on Monday directed the government-constituted technical committee on COVID-19 to consider all representations from practitioners of Sidha and other traditional Indian medicine with regards to treatment of the viral pandemic. Incidently, it was the first time in the annals of the Madras High Court, the judges, sitting at their respective residential offices, used a video-conferencing system to adjudicate the matter. Madras HC directs state govt committee to consider alternative medicine for treating coronavirus

Chennai (Tamil Nadu) [India], Mar 31 (ANI): Madras High Court on Tuesday directed a committee, set up by the Tamil Nadu government to consider representations by medical practitioners to prevent or treat coronavirus through alternative medicines.
A division bench of Justice Vineet Kothari and Justice R Suresh Kumar heard the matter through video conferencing and slated it for further hearing after four weeks or after the court resumes regular working following the relaxation of the lockdown.
“In view of the technical committee already having been constituted for this purpose during the present times of COVID 19 or coronavirus spreading the world over, we direct the said committee to consider all the concerning representations made in this regard to the State government, for prevention and treatment of the said disease,” the court said.
The High Court said that it hopes and expects that the said committee and the state government will take appropriate decision in this matter as quickly as possible so that the public at large can immediately avail the benefit of the same.
The court was hearing a petition filed by K Muthu Kumar Nayakar and Dr KM Senthamizh Selvan, members of the Ayush Medical Welfare Association.
The plea sought directions to the state government to constitute a committee to consider the representations to allow medical practitioners to provide relief to coronavirus affected people and others, as preventive measures or treatment in the form of alternative medicines by way of Ayurvedha, Siddha, Unani, Homeopathy or Naturopathy methods, besides Allopathy.
Additional Advocate General Arvind Pandian, representing the state government, submitted that the state government has already constituted a technical committee comprising of the experts in various fields, who will consider all such representations in this regard.
Pandian said that the committee will also issue appropriate guidelines for practitioners of the respective fields and also for common public members and under which, such guidelines can be followed by the persons concerned. (ANI)

Interim bail granted even in murder, attempt to murder and corruption cases too

The Madras High Court has been lenient in granting interim bail to the accused even in murder, attempt to murder and corruption cases by taking into consideration various factors including the threat posed by the pandemic COVID-19.

Justices A.D. Jagadish Chandira and P. Rajamanickam have ordered the release of many accused on interim bail after observing, in their individual orders, that the interim relief was being granted in view of the extremity of the present situation.

When a bail petition filed by K. Appu came up for hearing, Justice Rajamanickam found that the petitioner had been accused of being part of a gang that had abducted an individual in an auto rickshaw and murdered him due to personal enmity.

The Ice House police in the city limits had arrested some of the accused on January 20. However, since then, four of them had obtained bail. Considering all these facts as well as the threat of COVID-19, the judge granted interim bail till April 27 to the present petitioner too.

Though Additional Public Prosecutor M. Mohamed Riyaz objected to grant of bail and stated that investigation was yet to complete, the judge ordered the petitioner’s release on execution of own bond for ₹10,000 to the satisfaction of Superintendent of Central Prison at Puzhal near here.

The court passed similar orders with respect to lorry driver Ramesh who had been booked by Kalasapakkam police in Tiruvannamalai district for attempting to murder a Special Sub Inspector of Police when the latter attempted to prevent smuggling of river sand on January 7.

Since he was under incarceration for nearly three months and a preventive detention order invoked against the petitioner had been subsequently revoked, the judge ordered his release too on own bond for ₹10,000 to the satisfaction of the Superintendent of Central Prison in Vellore.

In yet another order, Justice Chandira granted interim bail till April 28 to R. Elavarason, Superintending Engineer in Regional office of the Union Ministry of Road Transport and Highways in Chennai and M. Murugaboopathi, Divisional Engineer of Tamil Nadu State Highways department.

According to the petitioners’ counsel Abdul Saleem and S. Elambharathi, their clients had been booked by Central Bureau of Investigation on charges of demanding and accepting a bribe of ₹2.76 lakh from Vetrivel of Madurai based IVLR Concrete to clear his government contract bills.

Though the advocates claimed that the petitioners were innocent, Special Public Prosecutor K. Srinivasan opposed their plea on the ground that cash to the tune of ₹7.5 lakh, ₹10.59 lakh and ₹7.5 lakh was recovered from the residences Elavarason, Murugaboopathi and their conduit S. Ovu Reddy respectively.

The SPP also stated that the contractor Vetrivel was yet to be arrested and his anticipatory bail plea was pending in the court. However, the judge on perusing the records, found that the petitioners were arrested on March 5 and they had also been subjected to custodial interrogation.

Taking the factual matrix into consideration apart from the threat of COVID-19, the judge ordered their release on interim bail on own bail bond for ₹10,000 each.

A public interest litigation petition has been filed in the Madras High Court seeking a direction to the trial courts across the State to grant interim bail to all accused, except those involved in heinous crimes, after accepting their bail applications filed through e-mail.

Advocate G. Mohanakrishnan has filed the case alleging that the norm of physical distancing could be followed in the prisons to avoid spread of COVID-19 only if as many prisoners were released as possible by considering the nature of the cases in which they had been booked.

The Supreme Court too had passed a general order to that effect but the trial courts in the State remain shutdown for three weeks in view of the nationwide lockdown. Though litigants had been permitted to file extremely urgent cases through e-mail, they were not being taken up for hearing, he claimed.

Chennai, Apr 3 (PTI) The Madras High Court on Friday directed distribution of state government”s COVID-19 relief assistance meant for migrant workers essential commodities like rice and dhal at ration shops. A Special Division Bench of Justices Vineet Kothari and R Suresh Kumar heard four different petitions seeking separate relief, but all of which emerged from the present scenario of the nation”s battle against the scourge of coronavirus. Hearing a PIL that sought a direction from the Court to treat patients affected by COVID-19 using traditional ”Siddha” medicine ”Kabasura Kashayam”, the bench directed the Tamil Nadu government to take a decision on its usage in accordance with the guide lines issued by Central Government. In another plea seeking door to door delivery of relief assistance to ration card holders to avoid crowding in Public Distribution System outlets, the government submitted that direct handover was impossible. Detailed guidelines have been issued to avoid large gathering of people in PDS stores, the government submitted. The court recorded the submission, which cited guidelines like distribution of tokens to ration card holders to avoid crowd and directed the state to file a counter affidavit and posted the matter to April 9. Chief Minister K Palaniswami had announced cash assistance of Rs 1,000 to ”rice” card holders and essential commodities ike rice, dhal and cooking oil free of cost to all types of card holders. After hearing another petition, the bench directed distribution of relief -essential commodities- to migrant and construction workers at PDS outlets nearest to their present place of stay considering their inconvenience in approaching the district collectors” offices.
The matter was posted to April 9. The government had announced 15 kg of rice, one kg each of dhal and cooking oil to migrant and construction workers as part of its COVID-19 relief measures. In another plea which sought a direction to the State to form a High Powered committee to determine the class of prisoners who could be released on parole or interim bail in view of the Supreme Court directions, vis-a-vis COVID-19 scenario, the senior most judge of the bench Justice Vineet Kothari said the panel has already been constituted and he was its chairman. The apex court had directed states and union territories to set up HPCs to decide on prisoners” release. The bench then issued notice to Additional Advocate General P H Arvind Pandiyan and directed him to inform police to give instructions on bail applications at the earliest and fixed April 8 for further hearing. [4/5, 08:00] Sekarreporter 1: [4/4, 22:27] Rubt Three: என் நூலகத்தில் லா வீக்லி சிவில் புத்தகங்களை வாங்க வைத்ததே நமது உயர் நீதிமன்ற நீதிபதியே காரணம். ஆர்டர் 37 சிபிசி வழக்கில் கீழமை நீதிமன்றத்தில் ஆர்டர் 7 வகைராவில் வக்காலத்து தாக்கல் செய்து அது தீர்ப்பு எதிராய் வந்த வழக்கு .சிவில் ரிவிசன் பெட்டிஷன் தாக்கல் செய்து நீதிபதி முன் வந்த பொழுது நான் வாதித்து வக்காலத்து தாக்கல் செய்தாலே போதும் தனிப்பட்ட முறையில் மனுதாரருக்கு தெரிவிக்க அவசியம் இல்லை மற்றும் வக்காலத்து தாக்கல் செய்தாலே எதிர் மனுதாரருக்கு வழக்காட தகுதி இருக்கு என்று வாதிட்டேன் இதுவே மொத்த 37 வைகராவை கவர் செய்கின்றது என்று வாதிட்டேன். எதிர் மனுதாரரின் வழக்குரைஞர் 37 எல்லாம் நீதிபதிக்கு வாசித்து காண்பித்து சில தீர்ப்புகளை காண்பித்து என்னுடைய மனுவை தள்ளு படி செய்ய வேண்டும் என்றார். நீதிபதி எதிர் வாதம் உண்டா என்றார் நான் இல்லை நான் வாதிட்டது சரி என்று நின்றேன். நீதிபதி என்னை பார்த்து கேட்டார் எனக்கு சாதகமாக ஏதாவது தீர்ப்பு உண்டா என்று வினவ நான் தீர்ப்பு தேடவில்லை என்றேன். நீதிபதி எந்த அடிப்படியில் நான் இத்தகைய வாதம் செய்தேன் என்று கேட்க தோன்றியது வாதிட்டேன் என்று சொல்ல நீதிபதி நான் எடுத்த கிரௌண்ட் வாதம் எனக்கு சாதகமாக உள்ளது அது மெட்ராஸ் உயர் நீதிமன்ற தீர்ப்பு என்று வருடத்தை சொல்லி 2 நாள் வாய்த்த கொடுத்து மீண்டும் வழக்கு வாதம் வந்த பொழுது ரூபர்ட் அந்த தீர்ப்பை கண்டு பிடித்து விடீர்களா பிடுத்து விட்டீர்களா என்று வினவ அந்த தீர்ப்பை புன்முறுவலுடன் காண்பிக்க அவரும் புன்சிரிப்புடன் வாங்கி எதிர்மனுதாரருக்கு காண்பித்து அதை வைத்து எனக்கு சாதகமாக சாதகமாக தீர்ப்பை எழுதிவிட்டு என்னை கேட்டார் தீர்ப்பையே பார்க்காமல் எப்படி
அதே மாதிரி வாத்திட்டாய் என்று என் பதில் அவ்வாறே என் எண்ணத்தில் தோன்றியது வாதிட்டு பார்ப்போம் என்ற அடிப்படையில் வாதிட்டேன் என்றேன்.அந்த வழக்கை நடத்தியது எதிராக நடத்தியது அந்த நீதிபதி தான். சில சிவில் வழக்குகளை அந்த நீதிபதி முன் நடத்தி இருக்கிறேன் தீர்ப்புகளை காட்டும் போது ரூபெர்ட் யூ ஆல்வேஸ் ஷோ அத்தர் ஸ்ட்ஸ் ஜுட்ஜ்மெண்ட் லீவிங் அவர் கோர்ட் ஜுட்க்மென்ட்ஸ் விச் ஆர் இன்பேவார் ஆப் யூ. அன்று முதல் லா வீக்லி சிவில் புத்தகத்தை வாங்க ஆரம்பித்தேன் மூத்த வழக்குரைஞர் செல்லசாமியிடம் இருந்து 1962 இருந்து 1979 வரை வாங்கி விட்டேன். அந்த நீதிபதி பின்னாளில் உச்ச நீதிமன்ற நீதிபதியானார்.

to be cultivated by a junior lawyer by keen observation. There existed a system
wherein a newly enrolled lawyer joined the chambers of a senior and from them on
virtually lived life like in a Gurukulam under the guidance and mentorship of his senior.
A lot of traits for good advocacy emerged from the office that he or she joined as a
junior. When a junior lawyer stands before a court, his pedigree was traced from the
office from which he or she comes. The junior advocate used to have the advantage
of picking up skills of advocacy by closely observing their senior and many other
seniors (on the advice of their senior) when they argue in courts. These traits,
combined with the individual skill of the junior advocate, paved way for their fruition
into a fully bloomed lawyer. This trait can be acquired only by experience and
therefore, it is only natural that it takes a long number of years to acquire it.
The next question would be “why should this even be discussed and
written about, if it is an acquired skill?”. The necessity has arisen since the senior-
junior relationship seems to be slowly on the verge of its death. Law practice is taking
a different shape and we have entered an era of junior advocates entering into law
firms and starting their practice. Some even feel that they can start practice on their
own, from day one. There is a real urgency for the Bar Council to take stock of the
situation and mandate compulsory internship or experience as a Junior
Counsel/Associate with some office for a minimum period of time, as a pre-
requirement for starting their independent practice. It is very important to instill this

chance, since the source from which they acquired this skill before is slowly closing
down.
As a judge, I watch young advocates who are otherwise smart and
sharp, lacking in advocacy. Many of them seem to have an impression that their
bookish knowledge on law and oratorical skills are more than enough to start with
their independent practice and appear before courts. They seem to be missing one
very fundamental fact, being the person sitting before them as a judge is a “Human
Being”. I thought that I can utilize this time provided by COVID-19 and write my
thoughts on this trait- “Advocacy”. Even if one junior advocate benefits out of this
exercise, it is worth the effort.
Bruce Lee once when he was asked to describe Kungfu said “It is an art
of fighting without fighting”. Similarly, “advocacy is an art of arguing without arguing”.
The art of advocacy can be understood from the two very succinctly put paragraphs
from a book written about a famous Queens Counsel Jeremy Hutchinson by Thomas
Grant called “Jeremy Hutchinson’s Case Histories”. I am extracting the same
hereunder:
“Advocacy is the art of persuasive and attractive speech.
Nowadays the student must attend many hours of ‘advocacy
training’. Indeed the main remaining role of the Inns of Court

[4/6, 07:30] Sekarreporter 1: [4/5, 18:56] Rubt Three: justice சுதந்திரம் அவர்கள் சொல்லும் கொலை வழக்கு பாண்டிச்சேரி டிரிப்பில் மர்டர் கேஸ். இந்த வழக்கை 8 ஆண்டுகளாக பல காரணத்தால் 22 அக்கியூஸ்ட்களுக்கு நான் நடத்திய வழக்கு ஆனால் ஒருவரும் தூக்கு தண்டனையோ வாழ்நாள் தண்டனையோ பெறவில்லை. மாக்ஸிமும் தண்டனை 5 ஆண்டு.அதன் மேல் முறையீட்டு அவரிடம் தான் வந்தது. அவர் என்னிடம் வினவியது நான் எவ்வளவு நாள் இந்த அப்பிலை நடத்துவேன் என்ற பொழுது முடிந்தவரை விரைவில் என்ற பொழுது அவர் சொன்னது நான் இன்வெஸ்டிகஷன் ஆபிசரை 45 நாள் குறுக்கு விசாரணை செய்ததினால் கேட்கிறேன் என்றார். அவர் சொல்லி தான் எனக்கே தெரியவந்தது 45 நாள் பற்றி. எனக்கு அவர் கொடுத்த நேரம் ஒரு நாளைக்கு 2 மணி நேரம் தினமும் மதியம் 2.15. நான் என் வாதத்தை 3 நாட்களில் முடித்து விட்டேன். சிலர் விடுவிக்க பட்டனர் சிலரின் தண்டனை குறைக்க பட்டது. Its a big victory for me in a Triple Murder case.பாண்டிச்சேரி கேஸ்சில் மறைந்த வேணுகோபால் மற்றும் விமல் உறுதுணையாக செயல் பட்டன்ர்.

[4/6, 07:33] Sekarreporter 1: 2nd day story advt Rubt —-மனுதாரர் சார்பில் ரெவியூ பெட்டிஷன் ஆஜரானேன் எதிர் மனுதாரரின் வழக்குரைஞர் உச்சநீதி மன்ற நீதிபதியாகவும் ஆகிவிட்டார். இரவு 6.45 மணிவரை வாதிட்டேன். தீர்ப்பை நீதிபதி எழுத ஆரம்பித்து கடைசியில் கோர்ட் நேரத்தை 1-1/2 மணி நேரம் வீண் அடித்தேன் என்று என் மீது ஸ்ட்ரிக்செர் எழுதி போகம் பட்சத்தில் அவரிடம் நான் கூறியது நான் எந்த தவறையும் செய்யவில்லை பெல் அடித்த வுடன் நீங்கள் பார்ட் ஏரேட்என்று சொல்லி தேதி கொடுத்து இருக்க வேண்டும் அவ்வாறு செய்யாமல் நீங்கள் அமர்ந்து கொண்டு சுவாரிசமாக என் வாதங்களையும் தீர்ப்புகளையும் கேட்டு கொண்டு இருக்கும் பொழுது கோர்ட் மணி அடித்து விட்டது மீதி வாதங்களை நாளையோ அல்லது மற்றொரு நாளில் வைத்து கொள்ளலாம் என்று நான் சொல்ல முடியாது எனவே தவறு என் பக்கம் இல்லை ஆகவே என் மேல் இருக்கும் ஸ்ட்ரிக்செர்ரை நீக்குவது சரி என்றேன். பார்க்கலாம் என்று சொல்லி எழுந்தார் அப்போ நான் நீதிபதி இடம் சொன்னேன் சுருக்எழுத்தாளர் இடம் ஸ்கோர் அவுட் தட் போர்ஷன் என்று சொன்னாலே போதும் என்றேன். நீதிபதி கோர்ட்டில் இருந்து ஐ வில் திங்க் ஓவர் இட் & டிரஸ்ட் மீ என்று சொல்லி போய்விட்டார் போய் விட்டார் அடுத்த நாள் 2.15 மணி லிஸ்டில் முதலாவது ஐயிட்டம். இரு வழக்குரைஞர்களுக்கும் தெரியவில்லை ஏன் லிஸ்டில் இருக்கு என்று வழக்கு கூப்பிட பட்டு என் மீது இருந்த ஸ்ட்ரிக்செர் நீக்குமாறு டிக்டேட் செய்து ஆர் யூ ஹாப்பி என்று சொல்லி யுவர் ஸ்டண்ட் டு ஸ் கரெக்ட் பார் எக்ஸ்பஞ்சு என்றரர். தை செய்தவர் காலம் சென்ற ஸ்ரீநிவாசன் அவர்கள் தான் அவரால் தான் நான் லா வீக்லி சிவிலையும் வாங்க ஆரம்பித்தேன். என்றுமே அவர் என் வாதங்களை புன் முறுவலுடன் கவனிப்பார்

In the same line of thoughts
I would also wish to reminiscence about my experience before your Lordship with my Senior..

The case was – Gopal (BSNL -LineMan) Vs State rep by CBI

This was a very Pathetic case where the Petitioner has been wrongly framed.

I had conducted the Trial in the lower Court and cross examined almost 5 witnesses.
The Trial Court convicted the Appellant and a sentence of 2 years was imposed with 10000 fine..

When your Lordship was sitting in the Single Bench, I had mentioned it to your lordship to hear the Appeal case.
Your Lordship infact quipped me as to whether I was really intended to Argue the appeal before your lordship.
Finally your lordship had aggred to my request and the case was directed to be listed at 2:15 for arguments..

After I had mentioned many were skeptical as to why i had mentioned the appeal to be taken by your lordship and they also scared me by saying that your Lordship would dismiss the appeal and not grant it. Further your Lordship had strictly ordered that if I do not argue the case on Wednesday (date of Listing) that he would dismiss it.

I was so petrified and After I had come to the Famous Tree Bar Association i had discussed it with my senior Rupert Sir and finally he agreed to appear in the case.

The day finally came for the arguments and it was specefically posted at 2:15 everyday.

I had brought Mr.Rupert sir on the first day of argument and your Lordship was plesantly suprised to see him and quipped me whether there was anymore suprise or in store for me🙂

The arguments went on for a week and all the statements of the witnesses were elaborately read out to your Lordship..

After the arguments were over your lordship had reserved the orders.

But on the day when the orderes were passed and when i had read the same I was more than happy and all the points that was argued was there in the Order and above all there was also a very reasoned observation made by your lordship in the Judgment which will always stand out. The Judgment was soo precise that the same was throughly appreciated by many..

I would also wish to quote the comment made by your Lordship in the open court while pronouncing the order..
In quotes ” The Counsel should not Test the Patience of the Bench this much. I had infact understoon the case when the statement of PW3 was read out, but the counsel did not leave me and made sure I hear all the statements of the Witnesses”

I also want to mention here about my Senior Mr. Rupert sir
He is a great person and very knowledgeable man who has an immense knowledge in Law and the practice..

Though his arguments would seem a little rude to many the way he handles the Trial is commendable..
He had taught me many things and one important quality that I admire is the way he prepares the Affidavits.
He would read the drafts over and over till he is satisfied and makes correction all the way till it reaches the registry.

His drafting skills are highly commendable.
But
All said If only he had a little patience in his life things would have been much better and he would have definetely reached great places..
But i would say that he is still a well-read and a knowledgeable man..

I would like to thank Your Lordship for giving such a wonderful judgment and also for this moment for helping me share this with all..

As this case was dragged for a very long time I determined to finish the case when I got the opportunity. Several senior advocates including mr. K.S. Dinakaran and present public prosecutor mr. Natarajan appeared along with mr. Rubert I think mr. Rubert repeated reading of each prosecution witnesses made the court job and my job very easy. As soon as mr. Rubert finished reading each witness statement I just used to pin point the witnesses evidence which implicated the part of each accused which helped the court to made up its mind immediately. As I love watching boxing and as the best strategy in boxing is to make the opponent to allow to run endlessly to make him tired I also adopted the same strategy by keeping very quiet without interfering while my friend mr. Rubert argued as I know mr.Rubert very well from day one of his entering the profession and I also know that any unnecessary interference from my side will make my friend to argue endlessly.The case resulted in severalpeople getting convicted by the high court.

He was in full anger with me. I told him that I was following but your Company case has not been listed. Then I went to the registry and found my name has been printed in the list wrongly as Robert F.Bernad instead of Rupert J.Barnabas. I told the company I will set aside minutes everything and no need to worry for it. The matter came before Late M Srinivasan and argued I am not at fault and had my name been printed correctly I would have appeared before you Lordship and therefore its case for setting as side the entire proceedings. Late Biksheshwaran was the Plaintiff’s Counsel and he seriously opposed my case. His point was that every Advocate must search by case number. I anticipated that Late Bikshewaran will take such a stand. Hence I was ready to counter him and produced some old judgments of 1930-40 of some High Court that Advocates go by their name but not by the case number. Late Srinivasan the judge agreed with my stand and judgments and rejected Plaintiff’s Counsel and set aside the entire proceedings. I saved the company

While his Lordship K. Venkatraman sitting in CRP, as junior advocate, hardly 1 year experience, i represented for getting adjournment, as my senior asked. Since it was around 4pm and about ring bell at 4.30pm.
I represented before him that my matter may take more than 30 minutes, so it may adjourn to some other day.
His Lordship, with smile, asked how many books i have in my hand to read, I said one consumer act(bare act). Again he asked me how many pages that book has. I said 40 pages. He, with his own unwound language, asked me having 40 pages book u need to argue more than 30 minutes? Asked me to open the bundle. After reading revision petition, he dismissed my petition with liberty. It was witnessed by many lawyers and laughed for my conversation with judge. It happened in the year 2007, in the present court hall no.23. Still i laugh myself, whenever I remember this.

The case was allowed in 1997.. The writ petition was argued before three different Division Benches and finally the DB of Mr.Justice Dharma Rao and Ms.Justice Suguna had confirmed the same by a detailed order in 2008. The matter was taken on appeal. Earlier, notice was issued by a different Bench. Subsequently the Bench changed.. The hearing was just before Dusshera vacation.. the Bench which heard the Government side and my arguments was convinced that the SLP was without merits and made the said observation… Noting the Court’s views, the Central Government counsel sought time.. The Presiding Judge (one of our former CJ) however adjourned saying that they had a practice in Allahabad not to dismiss cases when people go for celebrations and that I can come next time to get the result.. The Judge appreciated my arguments and also enquired about my senior Mr. Prasad… He was happy to note that I carried a diary of case laws… It was at that time, Mr. M.N. Krishnamani, Senior Advocate who witnessed my arguments in Court, appreciated me and said that it was good that I was noticed by the Supreme Court.. I went with hope for the next hearing.. Initially, they took a pass over.. When the matter was taken up later, the AGI, with a battery of seven lawyers, appeared. He just addressed that the decision was erroneous and the Courts had given it wrongly.. No reference to any pages nor grounds.. not even the impugned order.. (less than two minutes) That’s it. The very same quorum started to dictate orders… I reminded the Bench about the observation in the previous hearing… nothing could change it and order was dictated without hearing my side… when I kept on arguing on merits by referring to the Annexures, the Court officer was asked to call the next case…. I was shocked… A case which was to be dismissed on earlier occasion, got allowed in few minutes.. it is more than 12 years now.. But the scar remains. I had no answer to my clients who were informed during earlier hearing that the case will be won.. What to say. I think that a Junior must be able to argue confidently even against an AGI without fear…That can happen only by affording a hearing.. without fear or favour, friendship or ill-will……
But, interestingly, such a hearing happened on a positive note to me in 2015 before Mr. Justice Dipak Misra in Court 5.. when I argued against Mr. Mukul Rohatgi, AGI. The Bench heard the AGI and asked whether I was ready, I said .. yes. They posed questions to me … When the relevant pages were shown and the points were explained, the Court noted just the points and the order under appeal… After fifteen minutes of hearing, the Court agreed with me and dismissed the appeal… I walked out happily.. So, it’s the Hon’ble Court which ultimately decides to “hear and decide” or “just decide.” When the second methodology is adopted, the lawyer feels ditched… but nevertheless take it in their stride… Thanks to NAVJ. His Article made me to recap some interesting experiences in Court and place it to all… Let us stay positive and productive, of course with Corona protective measures. 🙏🏻

I challenged it before the HC even that though there is no Stay when a superior Court has taken cognizance of the case below it should wait for the Court come of HC order. The case came before Justice K.M. Natrajan I argued and cited judgments from 1934 to 1967 of various High Courts regarding Cost. The Judge said for Rs.25- you are fighting out. Any how I am setting aside the Trial Court order not only on legal point but also for the amount of work you spent to trace out so many judgments just for Rs.25/-It was an unforgettable thing for me Rs.25/- was not an issue but for me was the issue when the HC has taken up the issue the Trial Court has to wait as nothing is lost. Cost was imposed because adjournment was sought by me that the case was admitted by HC yesterday and notice has been ordered to other side and to be heard day after tomorrow.

  1. I am the Petitioner herein and as such I am well acquainted with the facts of the case.
  2. I state that I am presently a member of the Bar Council of Tamil Nadu and Puduchery, the 2nd Respondent herein. I have also been the President of Madras High Court Advocates Association for about 10 years. I have all along spent much of my time and effort towards the betterment and advancement of the Advocate fraternity and the Advocate fraternity had in turn reposed considerable faith on me that I shall be addressing their needs at the appropriate times.
  3. I state that the Indian nation and the world nations are presently faced with a very challenging and grim situation owing to the Covid-19 virus. Almost all the nations across the world have implemented ‘Lockdown’ in order to contain the spread of virus. Owing to severity of the dangers of spread of the virus the Government of India has announced and implemented a ‘Lockdown’ from 25.03.2020 to 15.04.2020 for a period of 21 days. Even prior to the announcement of lockdown the Government of India as well as the Government of Tamil Nadu had been issuing advisories to the public and authorities to implement ‘social distancing’ and such other measures to counter the spread of Covid-19. It is common knowledge that since the beginning of March, 2020 the entire world had been shaken by the huge adverse effects of the Covid-19 and this has caused considerable financial loss to businesses and individuals.
  4. I state that the various Governments of the world nations have announced lockdown despite the imminent impact on all their economies which are likely to be very adversely affected by such a lockdown. The safety of and welfare of the lives of citizens completely outweighed all kinds of economic impact to nations and businesses around the world. India was already reeling under economic recession and the present lockdown is likely to put almost all the businesses into distress. The general public are likely to be drastically affected and the Central Government, State Governments and Reserve Bank of India had been announcing various measures to mitigate the sufferings of the people.
  5. I state that whereas the salaried class of people are slightly better placed, the people belonging to the unorganized sector are the most adversely affected. It is found that the respective trade arms/ associations of unorganized sectors are doing the best to address the concerns of their respective sector of people.
  6. I submit that the Advocate Fraternity is one of the unorganized sectors of the society. The Advocate fraternity forms an important part of the judicial process, being also known as Officers of Court, and the Advocates provide considerable valuable input in the justice delivery system and also contribute a lot in the mitigation of sufferings of the litigant public and other victims.
  7. I submit that being considered as one of the noble professions, the Advocate fraternity comprises of a mix of individuals having income range from very low to quite adequate. Unlike the salaried employment, Advocates have to toil for several years with very low income in order to sustain in the profession. It is only after putting in considerable years of practice do the Advocates get some grip in the profession as also adequate income to sustain themselves and their families. Many young advocates depend on some kind of partial financial support from their families in order to move ahead in profession. The Advocates’ fraternity also comprises several Advocates with poor financial background. They sustain themselves with the meager income that they get as they keep working. Senior Advocates also pay their juniors only as and when income flows in through constant flow of work.
  8. I submit that in a period of lockdown the entire work is paralyzed and there is practically nil income for both seniors and juniors. Seniors are also not in a position to take care of their junior advocates’ financial needs during these times. Most of the Advocates hardly have any savings to enable them to tide over the crisis period. The only option available to very poor and indigent advocates is to seek for hand loans from friends or relatives. They are lucky if they are able to get loans. Life becomes hell for others who are not able to get money from any source. Their very existence is at stake. It is all the more difficult to imagine the plight of their families who depend on their meager income.
  9. I submit that the Advocates Act, 1961 has laid down an important condition that an Advocate should not have any other occupation. Hence, most of the time the Advocates have to depend only upon the income from the profession although they may be capable of earning income from other means if permitted. The Bar Council of India and the Bar Council of TN & Puduchery, the 1st and 2nd Respondents herein, ensure that Advocates abide by the rules that are laid down to ensure that the Advocates are devoted to their profession, thereby expressly barring income through other parallel occupations. This is to ensure better quality of profession leading to better justice delivery system to the nation which is supposed to benefit the entire nation.
  10. I submit that the Bar Council of India and the Bar Council of TN & Puduchery, the 1st and 2nd Respondents herein, are endowed with an important responsibility to regulate the professional conduct of Advocates. At the same time the 1st and 2nd Respondents are also endowed with a responsibility to ensure the welfare of the Advocates. Section 6 of the Advocates Act, 1961 deals with “Functions of the State Bar Councils”. Sections 6(2) and 6(3) of the Advocates Act, 1961 state as follows:-
    “(2) A State Bar Council may constitute one or more funds in the prescribed manner for the purpose of —
    (a) giving financial assistance to organise welfare schemes for the indigent, disabled or other advocates;
    (b) giving legal aid or advice in accordance with the rules made in this behalf;
    (c) establishing law libraries.
    (3) A State Bar Council may receive any grants, donations, gifts or benefactions for all or any of the purposes specified in sub-section (2) which shall be credited to the appropriate fund or funds constituted under that sub-section.”
    Similar provisions exist under sections 7(2) and 7(3) of the Advocates Act, 1961 under the caption “Functions of the Bar Council of India”.
  11. I submit that as a representative of the Advocate fraternity I am presently noticing that several Advocates from poor background have been exposed to severe and miserable financial conditions owing to the present ‘Lockdown’ owing to Covid-19. Several advocates are facing severe income crunch, having nowhere to go, and they are found to be in a miserable condition especially when they have dependants to take care of. Some of the advocates are borrowing from their friends or relatives whereas some other advocates who are already indebted or heavily financially strained, find the present circumstances to be completely unmanageable.
  12. I submit that although the Lockdown is slated to end on 15.04.2020 there is a possibility of the Lockdown being extended, either in the same form or in a modified form, for some more weeks. From the national and global scenario it has become obvious that normalcy cannot be restored within a short time. Those Advocates who are already deprived of income owing to present Lockdown will find it almost impossible to sustain the few extra weeks unless the government or some other authority pitches in with the necessary financial support.
  13. I submit that the 1st and 2nd Respondents are endowed with not only the responsibility but also the authority to provide a helping hand to those Advocates who are in dire need during these challenging times.
  14. I submit that I have reliably learnt that the 2nd Respondent presently has a General Fund of about Rs. 10 crores at its disposal and I consider that a part of the available fund could be immediately used to address the immediate concerns of the financially struggling Advocate fraternity.
  15. I submit that though the Bar Council of Tamil Nadu and Puducherry, the 2nd Respondent herein, has a Welfare Fund under the Tamil Nadu Advocates’ Welfare Fund Act, 1987 the same cannot be utilized for any other purpose other than to provide for death benefits of Advocates. Whereas, from and out of the General Fund other activities of the 2nd Respondent like Administrative Costs, Meeting Costs, Legal Education Expenses are being met out. Under the present extraordinary situation the amount available under the General Fund can be utilized. At present, the 2nd Respondent incurs an expenditure of about Rs. 1 crore per annum towards the usual previously designated expenses. Hence, there is surplus fund available under the General Fund of the 2nd Respondent and the same can be put to use to provide immediate relief to the indigent Advocates. It is pertinent to state that a large part of the amount disbursed towards relief is likely to be replenished from contributions and donations from Government and other well placed members of the Advocate Fraternity which may be collected over a period of time more particularly after normalcy returns.
  16. I submit that a separate fund may be necessitated to be created to address the situation. A fund captioned “Bar Council of Tamilnadu & Puducherry-2020 Lockdown Fund- Financial Assistance to Indigent Advocates” could be created for this purpose. The 2nd Respondent can seek support from financially well placed Advocates to contribute to the fund as per Section 6(3) of the Advocates Act, 1961. Meanwhile, to address the urgency, the amounts available with the General Fund could be utilized to immediately disburse fixed amounts as relief to deserving Advocates.
  17. I submit that, being a senior member of the Bar, having put in several years of practice as an Advocate, I consider myself duty bound to personally help out the financially less privileged Advocates during these difficult times. I shall be contributing Rs.1,00,000/- (Rupees One Lakh only) towards the above stated fund towards providing immediate relief to the indigent Advocates. To my knowledge there are several other Bar Council Members and financially capable Advocates who are willing to make contribution according to their respective capacities to mitigate the suffering of fellow Advocates.
  18. I submit that the situation warrants that an amount of Rs.10,000/- be paid to each of the indigent Advocates, who can be identified by laying down some objective criteria. The objective criteria shall lay down a set of conditions to ensure that only indigent Advocates are benefited by this emergency measure.
  19. I submit that a High Court appointed Committee may be constituted under directions from this Hon’ble Court and it is desirable that the entire process of selection of Advocates and distribution is monitored by this Hon’ble Court. It is suggested that the Committee be comprised of Senior Advocates from the various Bar Associations from across the States of Tamil Nadu and Puduchery.
  20. I submit that owing to the urgency involved to disburse the amounts to indigent Advocates, it is desirable that the Advocates themselves self certify that they meet the objective criteria, with a possible recommendation from the President/ Secretary of the concerned Bar Association in which he/ she is a member. The Committee that had been newly instituted or the 2nd Respondent could later check and verify if the facts provided by the Advocates are true. If found to be false the particular Advocate could be asked to return or refund the amount disbursed along with penalty failing which their names could be struck of the rolls.
  21. I submit that one of our fellow Bar Council members Shri K.R.R.Ayyappamani had already sent a representation dated 30.03.2020 to the 2nd Respondent with copies marked to all the Bar Council members including me and as such the 2nd Respondent is seized of the matter which deserves to be considered. Owing to urgency I am relying on the same representation dated 30.03.2020 of Shri K.R.R.Ayyappamani and adopting it to file the present Writ Petition.
  22. I submit that owing to the ‘Lockdown’ the 2nd Respondent is also not in a position to organize urgent meeting of its members to discuss and decide upon this issue. All discussions are happening only through phone or E-Mail and no formal meeting could be held. Since the 2nd Respondent is also unable to conduct formal meetings to pass resolutions, the 2nd Respondent will also be able to act only if suitable directions are issued by this Hon’ble Court to hold virtual meetings, etc. The 1st Respondent is also in a similarly placed situation and they will be able to grant no-objection or approval, if so required, only if suitable directions are issued to them by this Hon’ble Court to adopt suitable means/ modes to provide speedy approval.
  23. I submit that the Bar Council of Kerala has taken similar measures to address the concern of the Advocates’ fraternity at Kerala and the Bar Council of India, the 1st Respondent herein, has approved the same. The Rules framed by the Bar Council of Kerala to extend relief is enclosed along with this Writ Petition as an Annexure. The Bar Councils of Delhi and Odisha have also undertaken similar relief measures with the approval of the 1st Respondent and more state Bar Councils appear to be under the process of undertaking similar relief measures to their respective Advocate fraternity. The 2nd Respondent can follow the model adopted by Bar Council of Kerala, maybe with certain required modifications, while adopting relief measures to indigent Advocates of Tamil Nadu and Puduchery.
  24. I submit that I am filing the petition in public interest in order to address the concerns of the indigent Advocates of Tamil Nadu and Puduchery during the lockdown period. I have no personal interest in the litigation and the petition is not guided by self-gain or gain of any other institution/ body and that there is no oblique motive other than of public interest in filing this writ petition. To my knowledge no other similar petition has been filed by any other person.
  25. I submit that I hereby undertake to pay the cost, if any, out of my own personal funds if it is to be found that this Writ Petition is intended for personal gain or motive. I have filed this petition based on information and personal knowledge. The copy of representation of Shri K.R.R.Ayyappamani was that received by me through my E-mail. The Rules framed by Bar Council of Kerala was also received by Whatsapp Messenger.
  26. I submit that I pay income taxes according to the money earned and my IT PAN card Number is AGVPP6172D. I have also filed my returns for all taxable income earned, and as applicable under the income tax rules.
  27. I submit that I have no other effective alternative and efficacious remedy other than to approach this Hon’ble Court, under Article 226 of the Constitution of India by invoking extraordinary Original Jurisdiction of this Hon’ble Court praying to issue a Writ of Mandamus for the following among other grounds

GROUNDS
(i) That Article 21 of the Constitution of India provides for life to be led with certain amount of dignity and that the same ought to be applied in the matter of indigent Advocates who are presently suffering financially owing to ‘Lockdown’ related to Covid-19.
(ii) That the 1st and 2nd Respondents are endowed with a responsibility to address the genuine concerns of indigent Advocates who have been severely affected by the present ‘Lockdown’ owing to Covid-19.
Sections 6(2) and 6(3) of the Advocates Act, 1961 state as follows:-
“(2) A State Bar Council may constitute one or more funds in the prescribed manner for the purpose of —
(a) giving financial assistance to organise welfare schemes for the indigent, disabled or other advocates;
(b) giving legal aid or advice in accordance with the rules made in this behalf;
(c) establishing law libraries.
(3) A State Bar Council may receive any grants, donations, gifts or benefactions for all or any of the purposes specified in sub-section (2) which shall be credited to the appropriate fund or funds constituted under that sub-section.”
Similar provisions exist under sections 7(2) and 7(3) of the Advocates Act, 1961 under the caption “Functions of the Bar Council of India”.
(iii) That when the 1st and 2nd Respondents regulate the Advocates’ profession by laying down conditions restraining any other involvement of Advocates in other occupations, part-time or full time, and especially when the 1st and 2nd Respondents are endowed with responsibility to address the concerns of the indigent Advocates, then it would only proper and appropriate for the 1st and 2nd Respondent to make use of all available resources within its means and possibility in order to address the immediate financial requirements of the indigent Advocates.
(iv) That the 1st Respondent has already approved similar such relief measures for the State Bar Councils of Kerala, Delhi and Odisha.
(v) I pray that leave may be granted to raise additional grounds at the time of arguments.

  1. I state that this is the first writ petition and I have not filed any other petition for the similar of same relief.
    Under the circumstances, it is humbly prayed that this Hon’ble Court may be pleased to pass an interim direction to the Respondents permitting the 2nd Respondent to form a fund under the caption “Bar Council of Tamilnadu & Puducherry-2020 Lockdown Fund- Financial Assistance to Indigent Advocates” in order to disburse relief amount to indigent Advocates identified and approved by a Committee to be constituted and monitored by this Hon’ble Court, pending disposal of the Writ Petition and thus render justice.
    Under the circumstances it is humbly prayed that this Hon’ble Court may graciously be pleased to issue a WRIT OF MANDAMUS or any other appropriate Writ, or order, or direction, in the nature of a Writ, to direct the 1st and 2nd Respondents to consider the representation dated 30.03.2020 and thereby through the duly appointed Committee provide emergency relief of Rs.10,000/- (Rupees Ten thousands only) to each of the identified indigent Advocate from the General Fund available with the 2nd Respondent through the new fund under the caption of “Bar Council of Tamilnadu & Puducherry-2020 Lockdown Fund- Financial Assistance to Indigent Advocates”, within a time frame fixed by this Hon’ble Court and pass such further or other orders as this Hon’ble Court may deem fit and proper in the circumstances of the case and thus render justice.

[4/7, 16:21] Sekarreporter 1: I was engaged to conduct a COFEPOSA case in 1984 I had been to prison to collect all papers furnished to detnue by Pondicherry Customs to file WP. It was the 1st COFEPOSA case in Pondicherry and officers were unaware of the procedures. The Superintendent of Prison blindly refused permission and told it’s the Home Secretary to grant permission. I met him and explained that without detention order and all other connected papers furnished to detenue detention order cannot be challenged in High Court yet he did not permit and told me to get order from High Court. He refused permission to me to buy Pondicherry (Security) Prisoners Act from Govt Press and this Act deals with COFEPOSA dentenue. It consisted of 13 Sections. I managed to get Xerox copy and challenged the entire Act as unconstitutional and violative of Article 14 21& 22 of Constitution of India with WMP to interview the Detnue to collect materials to file WP. To my utter surprise at the admission stage itself it was dismissed. I went on an appeal & it came before Chandurkar CJ Bench. CJ was shocked to see that number of sections of the Act has been challenged and told me to argue. He heared my arguments in detail as to how those sections are violative and it went on for more than a hour at admission stage. Pondicherry Govt Pleader cum PP Late Govindsamy who later became Judge of our High Court was present and CJ told him We find that there is force in my argument to claim the sections of the Act is unconstitutional.Take notice and inform your govt to amend them or else we will strike them. The interim order of the CJ was U can meet the detenue during Counsel visiting hours. Late Govindsamy on the next hearing date informed the Court that Govt has amended the Sections and accordingly it was disposed.
