‘I love the little boy you are now and the man you will become.’ This is the love of the parents for their son in the case in hand. The loving parents were put to shock when the son forbade them at their time of utmost necessity.

With the fond hope that the son will be bounden by the values that he is brought up and in acknowledgement of the deep love, the parents wrote a Settlement Deed, settling their hard-earned property to the eldest son. The happy son well settled abroad, immediately acts upon the Settlement Deed and the same is brought into force. Gradually, worldly pleasures foretake the values implanted in him by his parents and he moves away from the elderly parents who live with the only hope i.e., the son, in mind.

The father falls sick and the mother takes care of him. The mother also falls sick and there is no one to take care of them. There is no reply from the two sons for the call for help from the parents. Holding hope, the father writes an empathetic message to the elder son which would even melt a stone. The elder son does not heed to the cries of the father disabled by sickness and age. They sold their jewels and spent the little money they had saved for all the treatment expenses and got up gaining a little strength.

The pathetic state of the parents push them to take a decision to cancel the Settlement Deed executed in favour of their elder son. The son who did not respond to the cries of the parents immediately turned up, not to see the parents but to drag them to the Court, when the document gets cancelled.

The son challenged the cancellation of the Settlement Deed as null and void but the Trial Court did not accept the case of the son. The enraged son without any empathy approaches the doors of the next Court. The First Appellate Court failed to consider the merits of the case and agreed with the son. Now it is the turn of the parents to approach the High Court for the redressal of their grievances. Though the parents had no wherewithal to file a case in the High Court, the Legal Services Authority extended the helping hand to them.

The Hon’ble High Court speaking through Hon’ble Justice P.T. Asha, who heard the arguments of M/s. Sharada Vivek for the aged parents through the Legal Services Authority, gave back the life to the parents. While upholding, the act of the parents in cancelling the Settlement Deed, Hon’ble Justice P.T. Asha, sent a universal message to all the sons and daughters out there, by citing a Thirukkural, which speaks about the way of life and how a child should make the parent feel proud about the values they inculcated in the child.

The crying e-mail of the father which did not move the son, moved the Court through which Hon’ble Justice P.T. Asha sent a strong message to the children who desert and neglect their parents. The Court invoked S. 23 of the Maintenance and Welfare of Parents and Senior Citizens Act and declared that the parents are entitled to cancel the Settlement Deed, when the children fail to maintain the parents. This Judgement of Hon’ble Justice P.T. Asha is a light house for all the deserted parents and a guiding star for the children.
