[11/30, 10:34] Sekarreporter 1: Election petition ELP 3 of 2021 was filed by DMK candidate Mr. Palanisamy challenging the election of AIADMK candidate & former minister Mr.Vijayabaskar from the Viralimalai Constituency in the 2021 Assembly elections. The DMK candidate had filed the petition on, amongst other grounds, that Mr. Vijaybhaskar indulged in brivery of voters & abused his official position as minister. Mr. Vijayabaskar had filed an application to strike off paragraphs 9-45 of the election petition.

Learned Senior Counsel Mr. T.V.Ramanujam appeared for Mr. Vijaybhaskar and submitte that the averments in the election petition are scandalous and vexatious and should be struck off and no trial should be ordered on their basis.

Mr.Richardson Wilson, ld. Counsel for Mr. Palamisamy resisted the contentions and stated that the election petitioner had only set out the material facts required to prove the case and that there was nothing scandalous in pleading the facts that took place. He argued that the petitioner should be permitted to let in evidence to prove the allegations.

The case came up for hearing before Hon’ble Justice C.V. Karthikeyan of the Madras High Court.
