Thiru. P. Ramasamy, Sub Inspector of Police while working in Sathankulam Police Station involved in criminal case by screening the evidence and permitted the accused to burn dead body. To that effect, departmental enquiry and criminal case was conducted simultaneously. In criminal case he was acquitted since all the independent witnesses were turned hostile. In departmental proceedings, the Department had examined three witnesses as Prosecution Witnesses. Out of three witnesses, two of the witnesses turned hostile.
The writ petition came up before the Hon’ble Mr. Justice P.Velmurugan on 01.12.2020. The Learned AAG Thiru.A.Kumar had appeared on behalf of the Government and placing the Hon’ble Supreme Court in the case of State of Rajasthan and others Vs Heem Singh reported in 2020 SCC Online SC 886 and argued that there is material evidence to prove the charges. Even in honorary acquittal in criminal case, the delinquent is not entitled to claim any benefit including reinstatement into service as per the Hon’ble Supreme Court Judgment. This was accepted by the Hon’ble Judge and dismissed the writ petition. The Learned AAG Thiru. A.Kumar was assisted by Thiru. P. Chinnadurai, AGP in the writ petition.
