IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 17.03.2022
CORAM :
THE HON’BLE MR.MUNISHWAR NATH BHANDARI, CHIEF JUSTICE
AND
THE HON’BLE MR.JUSTICE D.BHARATHA CHAKRAVARTHY
W.P.(MD) No.2549 of 2022
S.P.Muthu Raman .. Petitioner
Vs
1.The Joint Secretary,
Department of Personnel & Training,
Ministry of Personnel, Public Grievances and Pensions, New Delhi.
2.The Secretary,
Department of Post,
Dak Bhavan, Sansad Marg,
New Delhi – 110 001. .. Respondents
Prayer: Petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents 1 and 2 to pass appropriate orders giving effect to the recommendation made by the Central Information Commission in the cases in File No.CIC/BS/C/2013/000149/LS, File No.CIC/BS/C/2013/000072/LS and
File No.CIC/LS/2010/00108 decided on 27.08.2013 with regard to the modality of payment of fee by introducing the RTI stamps of Rs.10/- by the Department of Post as expeditiously as possible within the time stipulation as prescribed by this Court.
For the Petitioner : Mr.S.Muthuvairam for M/s.R.Anand
ORDER
(Order of the Court was made by the Hon’ble Chief Justice)
This writ petition has been filed to seek a direction on the respondents for giving effect to the recommendation made by the Central Information Commission dated 27.08.2013. One of the recommendations is to affix postal stamp on the RTI application in
the place of Indian Postal Order or Demand Draft.
2. The petitioner, without finding out as to what action was
taken by the appropriate authority on the aforesaid
recommendation of the Central Information Commission, has made a representation on 21.01.2022. In other words, by way of this public interest litigation, the petitioner wants the Court to conduct a
roving and fishing enquiry as to what steps were taken by the respondents based on the recommendation of the Central Information Commission. The High Court cannot act as a post office to collect and exchange information. It is more so when even according to the petitioner, the Central Information Commission has
only made recommendations, which cannot by any stretch of
imagination be taken as a statute so as to give effect. It is for the authorities concerned to decide what action should be taken based
on the recommendation of the Central Information Commission.
3. In view of the above, we do not find any case for grant of the relief prayed for by the petitioner. The writ petition fails and the
same is dismissed. There will be no order as to costs.
