  • Supreme court has confirmed the death sentence awarded to the accused for rape and murder of a child of 7 1/2 years suffering from polio and mentally deranged.
    A child aged 7 1/2 years, handicapped and mentally deranged was sitting with her parents in a public Street. At that time, Manoj Pratap Singh, the accused aged 28 years came in a motor cycle, offered chocolate to her and forcibly took her away. Later, the body of the girl was recovered on his confession in a land in Rajasthan and on post mortem it was found that she was raped before murder.
    The blood stained motor cycle used by the accused was also recovered on his confession.
    The Rajasthan police prosecuted him for an offence under Sec.302, 376 IPC and also POSCO. After trial, the Sessions Court found him guilty and awarded him death sentence and the Rajasthan High Court confirmed it.
    In the Supreme court, Senior Advocate Mr.A.Sirajudeen argued for him and prayed for his acquittal and in the alternative reduction of sentence.
    The case was heard by a bench of three judges consisting of Justices Khanwilkar, Dinesh Maheswari and Ravikumar. In the judgment pronounced today, the Supreme Court refused to interfere with the judgment of the High Court. The Supreme Court confirmed the death sentence awarded to the accused.
