Pondichary governor case orders regarding appointment of election offices case orders reserved

[2/20, 17:32] Chandrasekar Central Govt Standing Counsel: WP filed by Local Admn Minister, Pondy was heard in detail by DB of 4th Court.Advertisement issued by Union Government for the appointment of SEC under challenge.Wanted appointment of SEC made by Ministers to be sustained.Sr.Advocate Mr.Sathish parasaran appeared for the petitioner. Learned ASG appearing for UOI argued that the appointing authority is Administrator under the relevant Act and Section 50 of UT Act mandates Ministers and administrator to comply with the directions of UOI and any contra decision taken by the Minister would be contrary to his oath taken as a Minister and cannot maintain writ petition.
Sr Advocate Mr Somayaji appearing for the Administrator argued that for Puducherry scheme of Act is different and unique which gives control to the president who in turn is administering through Administrator having over riding power over legislature. He further contended that the order under challenge is only an executive instruction and not a regulation as referred under 240 of the Indian constitution as contended by the petitioner as such binding under section 50 of UT ACT.After hearing the arguments the Hon’ble Bench Reserved Orders.
