MADURAI: The Madras high courtimposed cost on a petitioner for suppression and misstatement of facts in a plea which sought to forbear the authorities from removing an encroachment in Madurai district.
The court was hearing the petition filed by Jailani, who is the jamath president. He sought to forbear the authorities from demolishing a mosque situated in Kottampatti villageMelur taluk, in Madurai district.
The special government pleader submitted that as per the records, the property belonged to national highways.
A division bench of Justices N Kirubakaran and B Pugalendhi said that it has been brought to the knowledge of this court that the petitioner in 2019 had filed a petition seeking to quash the eviction notice issued by the officials, however, the same was dismissed by this court.
The judges noted that even in the affidavit drafted by the petitioner, there was no mention about his earlier petition filed before this court.
The judges further observed that a perusal of the photographs would show that only a thatched shed is put up and there is no evidence to show that the mosque is situated in that locality for nearly 100 years.

Since nobody has any right to encroach the land belonging to national highways, the judges directed authorities to remove the encroachment immediately within a week.
Observing that there is a suppression of material facts and also misstatement of facts in this petition, the judges dismissed the petition and imposed a cost of Rs 10,000 on the petitioner payable to the legal services committee of HC Madurai bench.

Man booked for trying to kill wife, children

Madurai: The Madurai police have booked a man on charges of attempting to murder his wife and two children by feeding them with poison.
The accused, identified as Sudalaimuthu from MMC Colony in Avaniyapuram is working in a grocery store. Police said that he got married to S Malathi, 31, nine years ago. The couple have two sons aged seven and eight.
Sudalaimuthu used to go home under the influence of alcohol and used to fight with Malathi demanding her to get dowry from her parents. On Thursday, Sudalaimuthu mixed rat poison in a beverage and fed it to his children and wife.
As the trio vomited continuously throughout the night, Malathi found out only in the morning that the drink was laced with poison. She immediately took her children and admitted themselves in a hospital.
A police team from the Avaniyapuram police visited the woman in the hospital on Saturday and got a complaint. Based on her complaint, a case was registered under the IPC section – 307 (attempt to murder) and 498 A (dowry related harassment).
Police said that Sudalaimuthu’s younger brother Iyyemperumal was also booked for abetment to the crime.
Police are searching for Sudalaimuthu, who is absconding. The condition of Malathi and her children is stable, they added.
