[6/29, 22:33] Sekarreporter 1: Initially a complaint has been lodged by advocates LOGANATHAN and Sasikala for an incident that took place while they were on cue for water, tamilamuadan had prior motive against the advocates who is in the field of real estate and used purchase properties using his clout and muscle power, these two advocates having own residence in a apartment situate at Guduvancherry and their only apartment was left over because the said tamilamuadan purchased all other flats by chasing others one or the other. The said tamilamuadan made several attempts to evict these two advocates on various occassions which he failed, on the date of occurance the said tamilamudans mother had a wordy quarell with these two advocates followed by a serious life threat given by Tamil amudan hiring local goons and for the incident the advocates lodged a police complaint and an FIR has been registered against tamilamudan and others. The next day when the inquiry was going on the said Tamil amudhan lodged a false and counter complaint against advocates LOGANATHAN and Sasikala practising at Madras High court, alleging as if his mother was pushed and due to that she died subsequently at hospital in the month August after lapse of one month later the incident. Charge sheet has been filed by the police against these two advocates and the same has been challenged by way of the present quash petition, the Honble court perused the entire records and the way in and which the charges levelled, senior counsel Mr. S. Prabakaran submitted that the cause of death has been very clearly found in the discharge summary that she died because of brain tumor and according to medical jurisprudence and law the case foisted is unsustainable and need to quashed and the allegations are baseless and it is deemed to be quashed and prosecution if let to proceed it won’t secure the ends of justice and on perusal of the entire records and reason the charges sheet filed against the petitiners LOGANATHAN and Sasikala has been quashed by Honble Mr. Justice Ilanthiryan by upholding justice.

Mr. R. Sankaranarayanan was born on 4th January, 1952, in Madurai, Tamil Nadu. Native of Tirunelveli, born to (late) Subedar Major (Honorary Captain) S. Ramanathan and Smt. Subadra and spent his early years in Nagercoil. As his (late) father was an ex-serviceman, his schooling was spread across India. He is deeply influenced by teachings of Ramakrishna and Vivekananda as he completed his schooling in Ramakrishna Mission at Chennai. He pursued his undergraduate degree in Commerce at Loyola College, Madras in 1971 where he met his guru Mr. Vedantam Srinivasan, one of the greatest intellectuals of Tamil Nadu Bar. Then he went on to complete his Law degree at Madras Law College in 1974 where his association with Mr. Vedantam Srinivasan continued and grew into a lifelong one.
He enrolled in the Bar Council of Tamil Nadu in 1974 and was groomed into a budding advocate by S. Ramasubramaniam, Sr Advocate of Ramasubramaniam Associates and by King & Partridge. He was later designated as a Senior Counsel. He is practicing in the areas of Corporate Law, Arbitration and general Civil Suits.
He also has a keen interest in activities intended to promote democracy and philanthropy. He was the Secretary of Citizens for Democracy, Tamil Nadu unit, and he actively participated in the battle for restoration of democracy during the Emergency period between 1975 to 1977. He was also actively engaged in People’s Union of Civil Liberties (PUCL). Between 1983-1987, he also organized rehabilitation of victims of riots in Sri Lanka, who had sought refuge in Tami Nadu.
Due to his early and lifelong association with the Military personnel, thanks to his late father, he also has great respect and regard for the men and women in armed forces. He has organized events to bridge the gap between men in uniform and the civilians, to bring to life the services and sacrifices of many unsung heroes through debates and elocution competitions in colleges. Reading and discussing history, playing bridge and educating poor young children are some of his passions. And he is admired by all those who know him for his wit and sense of humour.
He is well known for conducting the litigation between the Chhabria brothers (also known as Shaw Wallace brothers), which spanned nearly a decade.

In this Pandemic situation of Covid-19, the Courts are being allowed to function and only Urgent matters are being taken by the Hon’ble High Court and Sub Ordinate courts during this Lock-down period. Even though Further Lock down has been announced by the Government we would request your Lordship to consider the following aspects with regard to the functioning of the Courts :-

1. The Physical hearings of the High court may be commenced for the Bail, Anticipatory Bail and Habeas Corpus Petitions. Further Writ Urgent Admissions and other important urgent matters can be heard through Physical hearings.
2. Criminal Cases can be heard in a Separate Block and Writ Petitions may be heard in a Separate Block.
3. The cases in relation to Tamil Nadu Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Goondas, Immoral Traffic Offenders and Slum- Grabbers, Act, 1982 have to be listed for Final Hearings.
4. Entry of Advocates may be restricted and only those advocates whose name is found in the Cause List may be permitted inside the Court Halls that too after the screening of the Temperature and observing Hand Sanitizing procedures.
5. The Advocates may be permitted to file the physical filings into the Drop Box to be kept inside the premises of the High Court and to be monitored by the Staff.
6. In so far as the uploading of the Order copies are concerned, the same may be executed without any delay.
7. With regard to the functioning of the Lower Courts are concerned, the Lower Courts may also commence the physical hearings in Bail, Anticipatory Bail and other matters under Section 138 of the Negotiable Instruments Act.
8. The urgent Civil Cases in the Sub ordinate Court may be permitted to be moved physically and physical hearings may be conducted for the urgent cases.
9. In all cases before the Lower Courts, only the concerned Advocates alone be allowed into the Court Halls after completion of precautionary measures.

I request your Lordship to consider the above while issuing Notifications with regard to the functioning of the Courts after the lock down period.

வழக்கு விசாரணையின் போது,   சாத்தான்குளம் சம்பவம் தொடர்பாக சாட்சி அளித்த காவலர் ரேவதியிடம் தொலைபேசி வாயிலாக நீதிபதிகள் பேசினர்.  காவலர் ரேவதியிடம் நலம் விசாரித்ததோடு, பாதுகாப்பு குறித்தும் கேட்டனர்.  தைரியமாக சாட்சியம் அளித்த காவலர் ரேவதிக்கு நீதிபதிகள் பாராட்டு தெரிவித்தனர்.

பின்னர் காவலர் ரேவதிக்கு உரிய பாதுகாப்பு மற்றும் சம்பளம் வழங்க வேண்டும் என்று தமிழக அரசுக்கு நீதிபதிகள் உத்தரவிட்டனர். இந்த வழக்கில் சிபிசிஐடியின் விசாரணை நீதி கிடைக்கும் என்று நம்பிக்கையை ஏற்படுத்தும் வகையில் இருப்பதாகவும் நீதிபதிகள் பாராட்டு தெரிவித்தனர். தொடர்ந்து இந்த வழக்கின் விரிவான உத்தரவு பின்னர் பிறப்பிக்கப்படும் என்று கூறிய மதுரை உயர் நீதிமன்ற கிளை  வழக்கை ஒத்திவைத்துள்ளது.

The Additional Advocate General Mr Aravindh Pandian appearing for the Special Officer objected to any orders being passed and requested time to file Counter. The Hon’ble Judge while adjourning the matter to 20.07.2020 also observed that the members of the council may file a separate suit regarding the administration of the Tamil Film Producers Council Welfare Trust and seek directions in that suit as the Trust and Council are separate entities.
