Madurai: Madras high court has dismissed a physical education teacher’s plea to be included in the promotion panel saying he had obtained his MA degree through open university which is invalid according to University Grants Commission (UGC) regulations. Petitioner I Sundararajan had passed SSLC in 1974 and also completed a certificate court in physical education in 1979. He was appointed as physical education teacher in a government high school at Periyakovilankulam in Tirunelveli in 1988. He obtained MA degree under open university system in 1999 without having any basic degree which was an essential qualification for joining a postgraduate course. However, with the MA degree, he obtained a Bachelor of Physical Education (B.P.Ed) in 2001. The joint director of school education department sent a communication to all chief educational officers to send the seniority list of physical education teachers for promotion to the post of physical education director grade II. Since his name was not in the list, he inquired about it. The joint director sent a communication on May 17, 2010 informing him that he was ineligible on the ground that he did not have a general qualification of a bachelor’s degree. The petitioner challenged the communication before the HC Madurai bench in 2010 and sought to consider his promotion without insisting on the general qualification of a bachelor’s degree.

On perusal of the submissions,court observed that the petitioner had obtained MA through open university system without plus two qualification or basic degree. The judge said the BPEd degree obtained by Sundararajan though a summer course was also not valid under UGC regulations. In this regard, the judge referred to a Supreme Court verdict in 2009 which held that a postgraduate degree obtained through distance education programme in contravention of UGC regulations is not valid. Hence, as contended by the authorities, the petitioner who does not possess a basic degree is not eligible to show his BPEd degree to get promotion.
