IPS officer wins Rs 1 crore damage for defamation; moves Madras HC again for payment

CHENNAI: A senior IPS officer of inspector-general rank, who has won Rs 1 crore compensation order in Madras high court against three journalists, an editor and a publisher of a daily, as damages, has now moved the court to direct their present organisation to divert their salaries, as the they have no means to pay the compensation.
On February 18, 2020, Justice M Sundar passed the decree in favour of Pramodkumar, who had dragged O Thomas, printer and publisher of Deccan Chronicle and Holdings Limited, A T Jayanthi, editor, of the daily, V P Raghu, Vidyashree Dharmaraj, Pradeep Damodaran, then reporters of the daily, for having published defamatory news articles against him.
Now Pramodkumar has filed an execution petition before the high court. Admitting the plea, a masters court of the high court has ordered notice returnable in two weeks.

The issue pertains to a civil suit for damages moved by Pramodkumar in 2010 seeking Rs 1 crore as damages against the daily and the reporters for allegedly publishing defamatory news articles against him.
The defendants filed a common affidavit to the effect that the publications were made in public interest and that the material was already available in public domain in another legal proceeding. Thereafter, they were not represented in the suit.
Therefore, holding that the defendants have failed to discharge the onus or the stand taken by them through the common affidavit, the court passed an ex parte order in favour of the IPS officer.
