In. view of the above laches found in the case of the prosecution, we have no hesitation in holding that the prosecution has not proved its case beyond reasonable doubts and therefore, it would not be safe to convict the appellant/accused for the offences alleged against him. Accordingly, we allow the Criminal Appeal setting aside the judgment of conviction and sentence rendered by the Principal Sessions Judge in S.C.No.200 of 2016 dated 30.10.2018.
