nskj With regard to Contempt Petition, though interim order passed on 03.03.2023, it is relevant to note that the Transfer Order has been passed on 17.02.2023, wherein 7 Engineers have been transferred to various other places within the State of Tamil Nadu. In pursuant to the above transfer order the proceedings also issued to the Petitioner on 20.02.2023 and the proceedings also make it clear that she is directed to relieve from her duties on the afternoon of 20.02.2023 to enable her to join at the place noted the proceedings of transfer. Thereafter the Petitioner filed a Writ Petition on 27.02.2023 after the order of the relieving has been passed and when the matter came up for admission on 03.03.2023 the interim stay has been granted. It is relevant to note that before the interim order has been passed, the petitioner has already directed to relieve from the post. In such a view of the matter, this Court is of the view that no contempt will arise in this matter. Accordingly, Contempt Petition is closed. In the result, Writ Petition is Dismissed. Contempt Petition is Closed. Connected Writ Miscellaneous Petitions are also closed. S m subramaniyam judge –Thus, this Court has no hesitation in holding that the findings of the Railway Claims Tribunal in its order dated 14.03.2019 is not in consonance with the provisions of Section 79 of the Railways Act, 1989 and further the appreciation of facts and circumstances, interpretations of the provisions as well as the reasonings are also not in accordance with the established principles of law. Accordingly, the 35/38 [2/21, 17:39] Sekarreporter1: C.M.A.No.3545 of 2019 order impugned is liable to be set aside.
