Mrs.Hema Muralikrishnan, learned Senior Standing Counsel accepts
notice for the respondents and seeks some time to obtain instructions and
file counter.
The basis for the impugned proceedings for re-assessment is to
bring to tax capital gains that has, admittedly, being assessed in assessment
year 2016-17 under an order of assessment dated 29.12.2018. The
aforesaid order of assessment appears to have been challenged in appeal
only on the aspect of computation of capital gains. However, the Officer has
proceeded on the basis that the assessee has preferred an appeal against the
levy of capital gains tax itself and has thus proposed to bring to tax the
capital gains again in assessment year 2014-15, protectively and to
safeguard the interests of the Revenue.
Interim stay till 24.01.2020.
List on 24.01.2020. Counter be filed by then with an advance copy
served on the petitioner.
