The petitioner seeks a direction to the respondents to register FIR based on his complaint dated 12.05.2021 and investigate the matter under the Prevention of Corruption Act alleging that the public servants i.e., The Sub Registrar, Joint 2 SRO, Coimbatore colluded with two private individuals in registering the Sale Deed for a land in respect of a person, who is dead, claiming to be the legal heirs of the dead person by giving bogus Legal Representative Certificate.

  1. As per the complaint made to the Director of Vigilance and

Anti-Corruption, the first respondent and the Commissioner of Police, Coimbatore, an allegation is being made that the accused does not have any piece of land in respect of S.F. No.331/2B, but trying to grab the land by producing fabricated documents with the active connivance of the Sub Registrar by name Mr.S.Karthikeyan and Mr.Suresh Kumar, District Registrar, Coimbatore, particularly document relating to TSLR,

Chitta, Patta, Legal Heir Certificate and Death Certificate.  There is a specific allegation in the complaint that the transaction of the property was undervalued for the purpose of levying the stamp duty and

registration charges.  Besides, the petitioner also enclosed a letter issued by the Tahsildar, in support of his allegations. The connected documents, filed for registration, appear to be not issued from the office of the Tahsildar.  It is the further allegation that due to the active connivance of the above said public servants, they caused loss of Rs.4,06,544 to the exchequer. Supporting documents for registration were also said to be not produced.

  1. It is seen from the records that the Director of Vigilance and

Anti-Corruption, first respondent has forwarded the complaint to the Inspector General of Registration as early as on 31.05.2021.  But, till date, they have not received any reply in this regard.

  1. Learned Government Advocate seeks time to get

instructions and to file a status report.

  1. From the submissions made by the learned Government Advocate, I find that the Inspector General of Registration seems to be sleeping over the matter for the last one year. Such an attitude in respect of the matter relating to Prevention of Anti-Corruption Act against the

Public Servants especially, in the rank of Sub-Registrar and Joint 2 SRO, Coimbatore, is deprecated.

Post the matter on 07.07.2022.
