2. Respondent can file cross objection on the findings which he wishes to challenge even if the decree is wholly or in part favour of respondent

4. Appellate court can even if the suit is decided on merits order re trial
5. Appellate court can decide the appeal on merits where evidence on record is sufficient to arrive at decision
