CHENNAI: The
Madras high court on Friday granted
conditional bail to Coimbatore wall collapse
prime accused S Sivasubramanian. He has been directed to stay in Madurai till further orders.

Seventeen people died in the wall collapse near
Mettupalayam.

Allowing the bail application moved by Sivasubramanian, Justice N Seshasayee directed him to produce two sureties worth Rs 1 lakh each as a bail condition.

In his bail application, Sivasubramanian submitted that no person constructing a compound wall would imagine that it would create harm to his neighbours. Most importantly, no one would put his life in jeopardy by putting up a weak construction in his residential quarters. The fury of nature was such that even a well-constructed compound wall would give away. To connect a case of an accident to culpable homicide not amounting to murder is highly illegal, he added.

Sivasubramanian further submitted that he was involved in a textile business in Mettupalayam and that he would not flee from justice and that he would cooperate with the prosecuting agency in all possible manner.

Sivasubramanian, who had been absconding after the accident on December 2, was arrested by the Mettupalayam police on December 3 and got him remanded in judicial custody.

Based on a complaint from the village administrative officer, an FIR was registered against him for offences under Section 304(2) (culpable homicide not amounting to murder) of the IPC and Section 3 of the Tamil Nadu Public Property (Prevention of Damage and Loss) Act.
