The Supreme Court in Union carbide corporation vs union of India 1991 4 SCC 584 observed that section 144 of Civil Procedure code , 1908 doesn’t confer any new substantive right it merely regulate the power of the court in this behalf :
Essential condition for restitution:
1)The restitution sought must be in respect of the decree or order which has been reversed or varied
2) The party applying for restitution must be entitled to a benefit under a reversing decree or order
3) The relief claimed must be consequential on the reversal or variation of the decree. Or order.
