W.P.No.15090 and 15164 of 2021   D.KRISHNAKUMAR,  J.             The petitioners were trapped and arrested by the officials of Vigilance and Anti-corruption on 13.09.2008 and a criminal case was registered in Crime No. 8/AC/2008/SL under Section 120 (B) IPC r/w Section 7 of the Prevention of Corruption Act, 1988.  The petitioners were placed under suspension with effect from the date of arrest i.e., 13.09.2008 and after completion of investigation, charge sheet was filed and the matter was taken on file as Spl.C.C.No. 96/2014 on the file of  Special Court for Trial of Cases under the Prevention of Corruption Act, Salem.

Admk case full order This Court, cannot imagine what would be going to take place during the General Council Meeting held on 23.06.2022 and issue interim orders/directions in advance. In fact, it is well settled that in matter of internal issues of an association/Party, the Courts normally do not interfere, leaving it open to the association/party and its members to pass resolutions and frame a particular bye-law, rule or regulation for better administration of the Party since any decision comes forth among the Members of the General Council, it is well within their collective wisdom and this Court cannot insist the Members to act upon in a particular manner. It is for the General Council and its members to decide and pass resolutions and this Court cannot interfere with the process of conducting the General Council Meeting. Therefore, this Court is not inclined to pass any interim orders/directions, except making it clear that the General Council Meeting which is scheduled to be held on 23.06.2022 shall go on. Temple land case judge mahadevan order upheld by mhc # TN govt appeal dismissed–transfer of land to the Transport Department was in violation of the provisions of the Act of 1959 and Rule 13 of the Revenue Standing Order No.26, the order of learned Single Judge is not interfered with and the directions given by the learned Single Judge shall be forthwith given effect to. The Commissioner, HR & CE, would however be at liberty to exercise the power under Section 34 of the Act of 1959. With the aforesaid, the writ appeals are disposed of.
