Wilson, MP, on 6.12.2019 to amend Articles 217 & 224 of the Constitution to increase the age of retirement of Judges of High Courts across the country from 62 to 65 years was listed today at 2.30 PM for consideration and passing before the Rajya Sabha.

However since the House was adjourned in the morning this Bill was not taken up in the afternoon.

There has been a long pending demand for increasing the retirement age of HC judges. The retirement age of Supreme Court Judges is 65 while HC judges is 62. Thus there is disparity and discrimination in the retirement age. This early age of retirement was criticised by Parliamentary standing committee for law and justice in its report tabled before the Parliament. The committee recommended to the Ministry of Law and Justice to increase the age of retirement. Due to the pandemic for past one year there has been piling up of cases. Further the Union Government is not considering fresh appointments of judges to all High Courts, even after recommendations of Supreme Court collegium and there are huge vacancies across the country. This has created a deadlock in the judiciary. Out of 1100 posts of HC judges throughout India almost 50 % are lying vacant. This increase of retirement age will help to retain the judicial man power and help to deal with pendency of cases.
