[7/3, 11:48] Advt Purusothaman: Yesterday this matter Honble Supreme Court passed orders upholding the order of the Honble High Court of Madras. Honble High Court had awarded 27 Lakhs as compensation to the dependents of the deceased who at the time of his death was 41 years.

He succumbed to injuries when the shade in front of the Palladam Municipality’s public toilet situated inside the Bus Stand collapsed. The deceased had after returning from his days work as Mason had gone into the toilet to attend nature’s call and as it was raining stood under the shade of the toilet. The toilet shade collapsed.

Honble Supreme Court didn’t agree with the contention of the Municipality that it was an Act of God. In this case Honble High Court had applied the Sarala Varma and Pranay Shetthi guidelines for awarding compensation under Motor Vehicles Act for the tortious liability of the State and it’s instrumentalities for the negligence and omission of their servants.

Honble Apex Court was not inclined to interfere with the awarding of Rs.2 Lakhs as compensation for loss of consortium.

Honble Apex Court in effect didn’t reduce the award. But only ordered for adjustment of the Rs.4 Lakhs paid as solatium already by District Collector.

In High Court Division Bench of Honble Mr. Justice N.Kirubakaran and Mrs.Justice T.V.Thamilselvi passed the Judgement.

In the Apex Court their Lordships Honble Mr.Justice Veneet Saran and Honble Mr.Justice Dinesh Maheshwari passed the orders.
