21-1-21 mahaveer shivaji MHC advocate. when the state is declared as secular, how the department of HRCE maintained by the state. is it unconstitutional or not? it is direct interference with fundamental right of citizens by the state.In part III Art,15- the state shall not discriminate its people on ground of religion and Art 25-28 and 29-30 all deals with religious rights and allow the people to administer Sikhsthe religious institutions not by state and how the state maintained only with Indian religions not the foreign originated religion in India.therefore HRCE department has to be necessarily abolished, further it is not only interfering with secular affairs of temple and also with non- secular affairs that is religious affairs of temple and how such department entrusted with quasi- judicial power to adjudicate the disputes and it become one of the most worst department of our state. further the judiciary is also still empowering the department with its judicial interpretation, it’s all is not healthy for secular state. if all the principles of constitution keep on giving exception, it’s amount to not holding the constitutional ideals and it creates lots of anomaly and it encourages official to do with corruptions, when the law become less important than it’s rule. in my opinion now a days, the state is ruled by RULE OF RULES NOT BY RULE OF LAW …… thanks and follows
