Prayer: Writ petition filed under Article 226 of the Constitution of
India, praying for the issuance of Writ of Mandamus, directing the
1st and 2nd Respondents to grant admission to the petitioners

quota to have opted out at the time of selection. The petitioners
having approached this Court and sought for the relief, must
naturally get the fruits of their efforts put in by them. Admittedly, the
petitioners have also been kept in the waiting list. Therefore, they
must get the preference at the time of re-counselling. Thereafter, the
benefit of this order can also be extended to others as suggested by
the learned Advocate General based on the marks secured by them in
the NEET Examination. This clarity is required in order to ensure
that the petitioners are not left in lurch at the time of the
re-counselling.
8. In view of the above, there shall be a direction to the
respondents to proceed further with the re-counselling for students
within the zone of consideration falling under the 7.5% quota, to fill
up the reverted seats from the All India Quota.
9. Post these cases for passing further orders on 08.01.2021.
