[1/6, 00:43] Sivaji: 6 -1 -21 Shivaji MHC advocate: Indian parliament is possessed limited sovereign power, it’s power is controlled by constitution,so it cannot legislate any laws by overstepping the constitution. here the judiciary is watch dog of it . but practically Indian government not holding the sovereignty due to world’s big power. the constitution casted duty upon judiciary to uphold it but judiciary is trying but recent times it is loosing it’s independent and bending to govt. interference which inturn undermining constitution values and it’s spirit. the constitution created wings of govt for country governance under the system of ‘checks and balance ” but now it’s all fusioning towards one man show called personality cult. that is the system is fine good but the person in the system is wrong so we need to input good person.in India the system cannot be changed until the constitution is alive and head of the state and head of the govt need to be relook in it’s functional equivalent and it is the judiciary interpreted in unequal treatment and distribution in their powers.that is the power of the president is undermined due to judicial intervention and due to that it become puppet to head of govt. actually head of state is need to be more powerful than head of govt.that division of line is become so dull and invisible. now a days in India the Rule of Law is become less important than Rule of Rules. it is not good sign for healthy democracy………….. thanks and follows.
