[8/22, 19:41] sekarreporter1: The bail applications filed by the accused in the incident relating to the search done at Karur came up for hearing today before Hon’ble Mr Justice P.Dhanabal at Madurai Highcourt. Senior counsel R.Gandhi, Prabhurajadurai and Nedunchezian appeared for the petitioners and argued that offence is punishable below 7 years and the Hon’ble Supremecourt in several cases held that bail has to be granted and the accused are in jail for nearly 25 days and prayed for grant of bail. ASG ARL Sundaresan and A.P.Srinivas Senior Standing Counsel for the Income Tax Department appeared for the intervenors and argued that there is no automatic grant of bail even in cases where the offence is punishable below 7 years and always the seriousness and gravity of the offence have to be seen and in this case Govt officials were attacked while doing their official duty and documents have been taken away and when 50 more accused are there, few only arrested and properties are yet to be recovered and opposed the grant of bail. Public Prosecutor said that SP is monitoring the investigation and investigation is almost over and said that bail can be granted after getting undertaking from the accused that they will not repeat the offence. IT department strongly objected for the stand of the Prosecution and said that when the State has opposed the grant of bail in the trial court and Sessions court, now suddenly changing their stand before the Highcourt and pointed out that already the District and Sessions Judge observed that no steps have been taken by the prosecuting agency to interrogate the remanded accused.
